having been first duly sworn testifies as follows:

MS. NEAL: Today is April the 25th, 2012.

It is approximately 12:33 p.m. I am Detective
7
Alicia Neal, internal affairs investigator for
8
the Miami-Dade Schools Police Department. Mr.
9
Garnica, there's an affidavit there in front of
10
you. Would you please read it into the record?

THE WITNESS: I, Francisco Garnica, being
12
first duly sworn hereby state that my name is
13
Francisco Garnica, reside and work at 1410
14
Countyline Road, Miami, Florida. My date of
15
birth is 08-09-1968. Contact number is
16
305-652-6808. I am making the following
17
statement to Detective Alicia Neal who has
18
identified herself as an internal affairs
19
investigator for the Miami-Dade County Schools
20
Police Department, State of Florida, in
21
connection with case number IA number
22
12-001002003005 and 006. I am of sound mind
23
and I am not under the influence of drugs or
24
alcohol at this time. I understand that giving
25
false information in this statement is in

violation of Florida Statutes 837.05, false

reports to law enforcement authorities
3
punishable as a misdemeanor of the first
4
degree, and 837.06, making false official
5
statements punishable as a misdemeanor in the
6
second degree.

MS. NEAL: And did you sign that

affidavit, sir?

THE WITNESS: Yes I have.

MS. NEAL: Okay, and I have witnessed it
11
with you. Mr. Garnica, are you appearing here
12
today without any promises, without any
13
threats, or duress to provide information in an
14
investigation being conducted by the Miami-Dade
15
Schools Police Department?

THE WITNESS: Okay.

MS. NEAL: Is that -- you're here without
18
any --

THE WITNESS: Without any, yes.

MS. NEAL: Okay, and are you aware that
21
your conversation with me is being recorded?

THE WITNESS: Yes ma'am.

MS. NEAL: Are you aware that anything you
24
say may or may not be used at a departmental
25
hearing in the court of law?

Q (By Ms. Neal) Okay, thank you so much

sir. Mr. Garnica, what is your position here at Dr.
5
Michael Krop Senior?

A I am one of the assistant principals.
7
Q Okay, and I'm here today regarding a case
8
involving the -- around the T.M. incident and I just
9
wanted to find out from you how did you actually
10
become involved? There was a case around the time
11
of March 21, somewhere in that area, and somehow you
12
became involved. If you could please just state on
13
the record what your involvement was.
14
A My involvement is that I'm the assistant
15
principal that suspended T.M. He was suspended
16
because he was in possession of a -- some residue of
17
marijuana in a Zip-Lock bag.
18
Q Okay.
19
A That's the extent of my involvement.
20
Q Okay, did this case come to you through
21
the school resource officer, Officer Dunn? Was
22
there any involvement with him in this matter?
23
A It did not come through Officer Dunn, it
24
came through one of my security monitors. He was
25
contacted for a little while to identify the item
