D) The EO shall ensure that the application has been filledup correctly, completely and legibly; write down theApplication Form Number; return the forms to theapplicant and direct the applicant to the Data CaptureMachine (DMC) Operator concerned.E) The DCM operator shall proceed to capture thecomplete demographic and biometric data of theapplicant, after which the EO shall:
·
administer the oath,
·
affix his signature in the appropriate space of theform,
·
retain the three (3) copies,
·
cut the bottom portion of one copy of theapplication forms and give it to the applicant toserve as Acknowledgment Receipt and proof of filing of his application.
The application form of an applicant who fails to submit himself for the live capture of his biometric data shall not be accepted and deemed not filed.
When an applicant has already accomplished anapplication for registration and submitted the same to theEO, the application shall be subjected to a hearing heldquarterly or every three (3) months by the ElectionRegistration Board (ERB) composed of three (3)members, the election officer as chairman, senior publicschool official and local civil registrar, or in his/her absence, the city or municipal treasurer, as members.The ERB, through the EO shall set the hearing of applications for registration. At least one (1) week beforethe hearing, notice thereof shall be posted in the bulletin board of the city/municipal hall and the Office of theElection Officers.The EO shall notify the applicant of the date of the hearingand whether or not there is an objection to his/her application.If the application for registration has beendisapproved, one may file a sworn petitionfor inclusion with the proper Municipal or Metropolitan Trial Court, attachingthereto the certificate of disapproval of applicant's application and proof of service of notice of his/her petition tothe ERB.After the court has issued an order for inclusion, the ERB through theEO shall reactivate theapplication for registration previously disapproved byentering therein the order of inclusion and placingthe said application inthe corresponding precinct book of voters.
