that on August 5, 2013, at 10:00 a.m., or as soonthereafter as counsel may be heard, the proposed intervening plaintiffs will and dohereby move the Court to modify the stay entered April 24, 3013 (Dkt. 129) to permit consideration of the instant motion for a preliminary injunction and to enter a preliminary injunction — 1) restraining defendants from deeming class members Alexander BustosGarcia’s and Holga Martinez’s presence in the United States unauthorized for  purposes of 8 U.S.C. § 1182(a)(9)(B) pending readjudication of their applications for lawful immigration status in accordance with the Supreme Court’s decision in
United States v. Windsor 
, __U.S. __; 2013 U.S. LEXIS 4921, 2013 WL 3196928 (June 26,2013); and2) restraining defendants from denying class member Alexander BustosGarcia and Holga Martinez authorization to work in the United States, pendingreadjudication of their eligibility for lawful permanent resident status in accordancewith the Supreme Court’s decision in
United States v. Windsor

.This motion is based upon the accompanying memorandum of law andexhibits, and upon all other matters of record herein. A proposed order is lodgedconcurrently herewith.This motion is made following conferences of counsel pursuant to Local Rule7-3 which took place on May 2, 2013, and July 2, 2013.
