AN ACT concerning regulation.
Be it enacted by the People of the State of Illinois,represented in the General Assembly:
Section 1. Short title. This Act may be cited as theFirearm Concealed Carry Act.Section 5. Definitions. As used in this Act:"Applicant" means a person who is applying for a license tocarry a concealed firearm under this Act."Board" means the Concealed Carry Licensing Review Board."Concealed firearm" means a loaded or unloaded handguncarried on or about a person completely or mostly concealedfrom view of the public or on or about a person within avehicle."Department" means the Department of State Police."Director" means the Director of State Police."Handgun" means any device which is designed to expel aprojectile or projectiles by the action of an explosion,expansion of gas, or escape of gas that is designed to be heldand fired by the use of a single hand. "Handgun" does notinclude:(1) a stun gun or taser;(2) a machine gun as defined in item (i) of paragraph(7) of subsection (a) of Section 24-1 of the Criminal CodeHB0183 Enrolled LRB098 05760 MGM 35799 bPublic Act 098-0063
 
of 2012;(3) a short-barreled rifle or shotgun as defined initem (ii) of paragraph (7) of subsection (a) of Section24-1 of the Criminal Code of 2012; or(4) any pneumatic gun, spring gun, paint ball gun, orB-B gun which expels a single globular projectile notexceeding .18 inch in diameter, or which has a maximummuzzle velocity of less than 700 feet per second, or whichexpels breakable paint balls containing washable markingcolors."Law enforcement agency" means any federal, State, or locallaw enforcement agency, including offices of State's Attorneysand the Office of the Attorney General."License" means a license issued by the Department of StatePolice to carry a concealed handgun."Licensee" means a person issued a license to carry aconcealed handgun."Municipality" has the meaning ascribed to it in Section 1of Article VII of the Illinois Constitution."Unit of local government" has the meaning ascribed to itin Section 1 of Article VII of the Illinois Constitution.Section 10. Issuance of licenses to carry a concealedfirearm.(a) The Department shall issue a license to carry aconcealed firearm under this Act to an applicant who:HB0183 Enrolled LRB098 05760 MGM 35799 bPublic Act 098-0063
 
(1) meets the qualifications of Section 25 of this Act;(2) has provided the application and documentationrequired in Section 30 of this Act;(3) has submitted the requisite fees; and(4) does not pose a danger to himself, herself, orothers, or a threat to public safety as determined by theConcealed Carry Licensing Review Board in accordance withSection 20.(b) The Department shall issue a renewal, corrected, orduplicate license as provided in this Act.(c) A license shall be valid throughout the State for aperiod of 5 years from the date of issuance. A license shallpermit the licensee to:(1) carry a loaded or unloaded concealed firearm, fullyconcealed or partially concealed, on or about his or herperson; and(2) keep or carry a loaded or unloaded concealedfirearm on or about his or her person within a vehicle.(d) The Department shall make applications for a licenseavailable no later than 180 days after the effective date ofthis Act. The Department shall establish rules for theavailability and submission of applications in accordance withthis Act.(e) An application for a license submitted to theDepartment that contains all the information and materialsrequired by this Act, including the requisite fee, shall beHB0183 Enrolled LRB098 05760 MGM 35799 bPublic Act 098-0063
