NewsProgress on Jackson reforms
On 21 June this year, the Governmentpublished the
Legal Aid, Sentencing and Punishment of Offenders Bil
. Although there is no mention of civil lawcosts reform in the Bill’s title this is thelegislation that when enacted will endthe recoverability of success fees and After the Event insurance premiumsfrom Defendants. The Bill also containsa clause, which will enable new CivilProcedure Rules (CPR) implementingan additional Part 36 sanction of a 10%increase on damages.
Comment: the UK government remainscommitted to implementing Lord  Justice Jackson reforms (applying to the Jurisdiction of England and Wales) and overall these are likely to lead to significant costs savings for defendants. The CPRcommittee is reported to be already working on new rules to implement the reforms with a planned implementationdate of October 2012.
