(Def’s Mtn.at 6.) Plaintiffhas authorednumerous peer-reviewed papers and published two books. In 2001, Plaintiff served as “lead author” for a chapter of the United Nations’ International Panel on Climate Change (“IPCC”) Third Scientific Assessment Report.
In 2002, Plaintiff “was named as one of the fifty leading visionaries in science andtechnology by Scientific American, and has received numerous awards for his research.”
In 2009 approximatelyone thousandemails were apparently “misappropriated from aserver at the University of East Anglia’s Climate Research Unit (“CRU”).”
. at 8. Theseemails included correspondence between Plaintiff and CRU scientists, in which the CRU wascast in a negative light.
One particular email, written by Phil Jones (a CRU scientist) stated:“I’ve just completed Mike’s Nature
of adding in the real temps to each series for the last 20years (
from 1981 onwards) [and] from 1961 for Keith’s to
hide the decline
. As a resultof these emails coming to light, the University of East Anglia began an investigation into the“’honesty, rigor, and openness with which the CRU scientists have acted.”
The investigatorsconcluded that the “’rigor and honesty of the CRU scientists was not in doubt,” but that Jones’email referencing Plaintiff’s “’Nature
” was “’misleading’.”
“The‘Hockey Stick Graph’–named for its iconic shape resembling a hockey stick –attempts to representestimates of the world’stemperatures between 1000 and 2000 A.D., based (in large part)on theobserved growth invarious tree rings throughout the world. The ‘Hockey StickGraph’illustrates the authors’ theory of gradual declinein temperatures from 1000 A.D. until about 1900 A.D., followed by a sharp increase in the late 20th century.”(Def.’s Mot. 6.)
The data Plaintiffused in the creation of the ‘Hockey Stick Graph’ was referenced in the Report.
In his Complaint, Plaintiff alleges that he and his colleagues, as a result of their research, were awarded the Nobel Peace Prize as a result of their research. Defendants claim that the Nobel Peace Prize award, referenced in theComplaint, states that the award was given jointly to Vice President Al Gore and the IPCC.
