Dear Commissioner Roemer:

During my testimony today a question arose about when I saw President

Bush during August 2001. Unfortunately, my answer may have given you the
wrong impression,

The President was in Texas during most of August 2001. I did fly down to
brief him on Friday August 17,2001 and also briefed him in Washington when he
returned on Friday August 31, 2001.

During the time the President was in Texas, he was accompanied by a

senior CIA analyst who briefed him on average six days a week. That briefer
was in regular communication with CIA Headquarters and often directly with me.

Additionally, I met with the President in Washington at least six times

during the first eight days of September.

I hope this information is helpful in clarifying my contact with the White

House during this significant period.

RE: (U) Documents Responsive to Item Nos. 3, 5, and 33

of DCI Document Request No. 8

Dear Mr. Marcus:

(U) This responds to Item Nos. 3, 5, and 33 of DCI

Document Request No. 8 ("DR #8), dated 3 July 2003, issued by
The National Commission on Terrorist Attacks Upon the United
States (the "Commission"). In your memorandum of 26 August
2003, you identify Item Nos. 3 and 5 as among the "most
Important categories of documents requested by the Commission."

(U) The first page of each enclosed document has been

sequentially bates-stamped. In this, and all future document
productions, the first two digits of the bates-stamp identifies
the specific DCI Document Request to which the document responds
and the remaining digits refer to the document number.

(U) This production includes document numbers 0800844

through 0800910. All of these documents are, by prior
agreement, being retained by the Agency and are available for
your inspection at CIA headquarters. They include copies of:

CJA 0446
/ /KTOFORN/ / X T
MORI DocID: 1454063

Mr. Daniel Marcus

1. Documents responsive to Item Nos. 3 of DR #8

pertaining to briefing packages for Principals and Deputies
meetings (bates-stamp Nos. 0800844 through 0800870);

2. Documents responsive to Item Nos. 5 of DR #8

pertaining to preparatory materials for the DCI's meetings
with the National Security Advisor {bates-stamp Nos.
0800871 through 0800902); and

3. Documents responsive to Item Nos. 33 of DR #8

pertaining to materials prepared by the Counterterrorist
Center for briefing to the DCI that "concerned UBL, al
Qa'ida, or [certain] other foreign terrorist threats"
(bates-stamp Nos. 0800903 through 0800910).

(U) Please note the following regarding this production of

documents.

(U) First, some of these documents bear classifications to

which only the Honorable Thomas Kean, the Honorable Lee
Hamilton, and Mr. 'Philip Zelikow of the Commission have access.
Other documents bear classifications to which only Mr. Michael
Hurley, Ms. Alexis Albion, and Ms. Bonnie Jenkins of your staff
have authorized access. These documents have been removed from
the documents placed in your reading room at CIA headquarters
and replaced with placeholders. The markers indicate that the
documents are available for inspection ir
office at CIA headquarters.

(S) Second, for a variety of documents produced in

response to Item Nos. 3 and 5, we have removed all Memoranda of
Notifications and replaced them with placeholders indicating
that the documents have been removed. We took this step based
on our coordination with Mr. Dan Levin, the Executive Branch
focal point of contact.

(U) Third, for a variety of documents produced in response

to Item No. 3, we have removed documents prepared by the
National Security Council Staff and the State Department and
replaced them with placeholders indicating that the documents
have been removed. We took this step based on our coordination
with, and are forwarding the NSC materials directly to, Mr.
Levin. Also, we will coordinate with the State Department

regarding the handling and possible production of State

Department documents.

(U) Fourth, please note that the inclusion of talking

points as part of the Agency's response to Item No. 5 of DR #8
does not mean that- such talking points were actually used by the
DCI in meeting with the National Security Advisor. In addition,
the listing of topics in the talking points does not establish
that the DCI and the National Security Advisor actually
discussed the topic. -Likewise, the absence of talking points
concerning a particular subject does not establish that the
topic was not discussed between the officials, but only that no
talking points were drafted for the topic.

Re: (U) Response to Item No. 3 of DCI Document Request

No. 36

Dear Mr. Marcus:

(U) This responds to item No. 3 of DCI Document Request

No. 36 (DR#36), issued by The National Commission on Terrorist
Attacks Upon the United States (the "Commission") on
5 February 2004. The Central Intelligence Agency's (CIA) search
for documents responsive to item No. 3 of DR #36 netted a total
of 50 responsive documents. Upon review of these documents, we
have determined that CIA has previously produced to the
Commission 37 of the 50 responsive documents. Rather than
duplicate the Agency's prior production of documents, this
letter only produces the 13 documents that CIA has not
previously produced.

Documents responsive to this request are being produced as

document Nos. 3600003 through 3600015. In addition, document
No. 3600002 is a narrative response addressing the apparent
overlap between DCI Document Request No. 17 and item No. 3 of DR
#36, and further explains what is and is not being produced in
this response. All of these documents are, by prior agreement,
being retained by the Agency and are available for inspection in
the Commission's reading room at CIA headquarters.

were previously produced to the Commission and, if so, whether
document(s) were produced as part of the Joint Inquiry holdings

CIA's search of TDs responsive to DR #37 netted an approximate
total of 1100 potentially responsive TDs. After discussing this
fact with Ms. Nicole Grandrimo of the Commission staff, CIA is
now producing a list of the titles of the potentially responsive
TDs, in lieu of producing the actual TDs. It is our
understanding that the Commission staff will review the list,

Re:. Charts

Dear Mr. Marcus:

As we discussed, enclosed are two charts to which! Deferred during his

meeting with you and Philip Zelikow on January 19, 2004. The charts were created to assist my
client in preparing for his interview and are intended to compare, in summary form, certain
portions of the legal authorities with a policy proposal submitted in March 2001.

You have asked for copies of the charts, and we are happy to make them available with
the following understandings. First, neither the charts, nor excerpts of them, will appear in any
report published by the Commission without our prior consent. Second, copies of them will not
be shown to witnesses or interview subjects. Third, if the Commission makes any use of the
charts, my client will not be associated with them by name or by position and he will not be
identified as having sponsored them.

\e let me know if I can be of further assistance. We would like to help the

Commission with its work in any way possible.

\y truly yours,

(U) In a number of cases, Mr. Dan Levin, the Executive

Branch focal point for Commission matters, has requested that we
remove certain documents appearing in a package of documents
being produced with this response. In such cases, we have
replaced the document with placeholders indicating that the
document(s) have been removed. Please contact Mr. Levin
regarding the handling of removed documents.

(U) Please note that materials being produced with this

letter include a variety of talking points, briefing slides, and
other materials that we have located through a variety of
electronic and physical searches. In the absence of routing
information or some indication regarding the use to which a
particular document was put, the inclusion of these materials
does not necessarily mean that they were used as talking points
or briefing materials. Likewise, the absence of talking points,
briefing slides, or other materials concerning a particular
subject does not establish that a particular topic was not
discussed between officials, but only that no materials were
likely drafted for that particular topic.
