ThisdocumentcontainsthecompleteandonlypleaagreementbetweentheUnitedStatesDepartment

Justiceandthedefendant.Thisagreementsupersedesandreplacesanyandallpriorformalandinformal,writtenandoral,expressandimplied,pleaagreementsbetweentheparties.Nootheragreement,understanding,promise,orconditionbetweentheUnitedStatesDepartment
of
Justiceandthedefendantexists,exceptassetforthinthispleaagreement.

chargedwithconspiracytoprovidematerialsupportorresourcestoaforeignterroristorganization,namely

Qaeda,inviolation
of
Title
18,
UnitedStatesCode,Section2339B(a)(l).

Thedefendanthasreadthechargetowhichhe

pleadingguilty,andthechargehasbeenexplainedtohimbyhisattorney.Furthermore,thedefendantacknowledgesthathefullyunderstandsthenatureandelements
of
thecrimetowhichhe

pleadingguilty.

Theterm"terroristorganization"
as
definedinTitle18,UnitedStatesCode,Section2339B(g)(6),meansanorganizationdesignatedasaterroristorganizationbytheUnitedStatesSecretary

theImmigrationandNationalityAct.OnOctober

1999,
al
QaedawassodesignatedasaforeignterroristorganizationbytheSecretary
of
State,andhasremaineddesignated.A"conspiracy"
is
defined
as
anagreementbetweentwoormorepersonstoaccomplishanunlawfulpurpose(inthiscase,theprovision
of
materialsupportorresourcestoalQaeda).

Thephrase"materialsupportorresources,"asdefinedinTitle
18,
UnitedStatesCode,Section2339A(b)(1),means,amongotherthings,personnel,whichmaybeorincludeoneself.
7.
Tosustainthecharge
of
conspiracytoprovidematerialsupportorresourcestoal-Qaedaintheform
of
personnel
as
chargedincount
1,
thegovernmentmustprovethefollowingpropositionsbeyondareasonabledoubt:•First,thatal-Qaedawas,atthetime
of
theoffense,adesignatedforeignterroristorganization;•Second,thatthedefendantknowinglyagreedwithatleastoneotherpersontoprovidematerialsupportorresourcesto
al
Qaedaintheform
of
personnel,includinghimself,toworkunderalQaeda'sdirectionorcontrol;•Third,atthetime
of
thatagreement,thedefendantkneweitherthat
al
Qaedawasadesignatedterroristorganization,orthat
al
Qaedahadengagedorwasengaginginterroristactivityorterrorism;and•Fourth,thedefendantenteredintothatagreementwiththeintenttofurthertheterroristactivityorterrorismobjectives

Qaeda.

Thedefendantunderstandsandagreesthatthepotentialpenaltiesfortheoffensetowhichhewillpleadguiltyare:•upto
