QUESTIONS PRESENTED
California Civil Code sections 1746-1746.5prohibit the sale of violent video games tominors under 18 where a reasonable personwould find that the violent content appeals to adeviant or morbid interest of minors, ispatently offensive to prevailing communitystandards as to what is suitable for minors, andcauses the game as a whole to lack seriousliterary, artistic, political, or scientific value forminors. The respondent industry groupschallenged this prohibition on its face asviolating the Free Speech Clause of the First Amendment. The court of appeals affirmed thedistrict court’s judgment permanently enjoiningenforcement of the prohibition. The questionspresented are:1.
 
Does the First Amendment bar a statefrom restricting the sale of violent video gamesto minors?2.
 
If the First Amendment applies to violentvideo games that are sold to minors, and thestandard of review is strict scrutiny, under
Turner Broadcasting System, Inc. v. F.C.C.
, 512U.S. 622, 666 (1994), is the state required todemonstrate a direct causal link betweenviolent video games and physical andpsychological harm to minors before the statecan prohibit the sale of the games to minors?
