As the Fourth Amendment states: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Thus, we see that by conducting these sobriety checkpoints the police are, even by their own standards, engaging in criminal activity.

Do the police have any liability for their actions? When a person or business violates the rights of an individual they are directly responsible, both personally and financially. When the police cross the line by hurting or murdering a peaceful person they are never held financially (and often personally) liable for their crimes. Who is then? The tax payer. District of Colombia (state supreme court) case held that police do not have a duty to provide police services to individuals, even if a dispatcher promises help to be on the way, except when police develop a special duty to particular individuals. The main purpose of the police is to raise revenue for the government. The security they provide is a facade
