Do the police follow the law? Every police officer takes an oath of office to support and defend the Constitution. As the Fourth Amendment states: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Thus, we see that by conducting these sobriety checkpoints the police are, even by their own standards, engaging in criminal activity.

Do the police have any liability for their actions? When a person or business violates the rights of an individual they are directly responsible, both personally and financially. When the police cross the line by hurting or murdering a peaceful person they are never held financially (and often personally) liable for their crimes. Who is then? The tax payer.
