of"best
available technology" when
it
entered service
in
2004.
It
stillisin the forefi·ont
of
that technology.Built in2004, the vesselLakeExpressmeetsor exceeds
all
applicableregulationsforoperations in US waters for avessel
of
its kind and type. The vessel
was
built
to
minimizeitsenvironmental footprint and therefore was equipped with thelatest diesel engines; handles no ballast;
is
of
shallowdraftto reducedredgingneeds;and collectsand retains its blackand graywaterfor pumping ashore to approved sewagedisposal facilities.LakeExpress operatesunderthe2008 VGP (Vessel GeneralPermit) administered by the EPA.TheVGPdoesnot contai.n anyspecificallytailored provisions forLakeExpress,unlike the
S. S.
Badger.Section 5.3
of
the2008 VGP only appliesto theS.S.Badgerand alloweditto dump coal ash throughDecember
19,
2012, thuspromptingtheS.S.Badger
's
NPDES permit application whichin turn ledtothefiling
of
thislawsuit and proposed consentdecree

LakeExpresshasa major economicimpactonboth theMichiganandWisconsin economiesandtransports
in
excess
of
100,000peopleand automobiles per seasonacross the lake. LMCcharacterizes Lake Express as a
"c
ompetitor"and actsaccordingly intheir marketing campaigns.Passengersare drawnto the LakeExpress
feny
service fromWisconsin,Michigan,and Illinois, as well as frompoints throughoutthe United States. LakeExpressLLC has
at
least fiveinterestsin and
/o
rconcerns withthe proposed LMCConsentDecree:(1)

It isunfairtoother businesses,both existing and under consideration,thata competitor or potential competitorreceives

spensationsfromenvironmentallawsthereby giving that competitor an economic and/or operationaladvantagein themarketplace.
In
theLMCConsentDecree,the EPA has extended to the S.S.Badger
just
such advantages,
in
violation
of
itsown statedpolicy.

Unequal

Law
and Regulations:
The
EPA
is allowingthe S.S.
Bad
gerto
yet
again accumulate
an
unwarrantedextension
in
complying w
it
h generallyapplicableenvironmentallawand regulations that have been
in
effect fordecades. Moreover,thespecial treatmentthat
the
S. S.
Badger
bas,and
will
continue
to
receive
if
theConsent Decree is upheld,followsthe S.S.
Ba
dger
's
inability toactingoodfaithto fulfillpastpromises to address andendpollutiongeneratedbythe vessel's operation. Again,the
EPA
fails toupholdthe law andits ownpolicies and thereforefails in its obligation to protectthe publicinterest. (4)

thecostitwouldtakefortheS.S.Badgerto fully complywiththe law. Specifically,wereference the following statement

EPA
