AN ACT PROHIBITING TRANSPORTING OF CHILDREN SEVEN YEARS OLD AND BELOW ON MOTORCYCLES ALONG HIGHWAYS

WHEREAS, Article 2 Section 13 states that the State recognizes the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being. It shall inculcate in the youth patriotism and nationalism, and encourage their involvement in public and civic affairs. WHEREAS, transporting of children seven years old and below on motorcycle along highway is very risky and hazardous not on the life of the children seven years old and below but also on the life of all passengers. WHEREAS, in promoting and protecting the physical, moral, spiritual, intellectual, and social well-being of youth against accident that may arise in riding on a motorcycle, the congress find compelling reasons to enact a law prohibiting transportation of children seven years old and below on motorcycles along highways. Now, therefore, Section 1. Prohibited Act. It shall be unlawful to transport children who is seven years old or below on motorcycles along highways. Section 2. Penalties. A motorcycle driver found have been transporting children who is seven years old or below on a motorcycle along highway shall be penalized as follows: (a) For the first offense a fine of Five thousand pesos (Php5,000.00) and two (2) months suspension of drivers license; (b) (b) For the second offense a fine of Six thousand pesos (Php6,000.00) and three (3) months suspension of drivers license; (c) (c) For the third offense a fine of Seven thousand pesos (Php7,000.00) and six (6) months suspension of drivers license; and (d) (d) For the succeeding offenses a fine of seven thousand pesos (Php7,000.00) and automatic revocation of drivers license. Section 3. Repealing Clause- All laws, presidential decrees and issuances, executive orders, rules and regulations or parts thereof inconsistent with the provisions of this Act are hereby repealed or modified accordingly. Section 4. If, for any reason or reasons, any part of the provision of this Act shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

Section 5. Effectivity. This Act shall take effect fifteen (15) days following the completion of its publication in the Official Gazette or in two (2) national newspapers of general circulation.
