If you do not have at least 90 consecutive days of tax information or pay period earnings documents for your Compensation Period and the same consecutive 90 days for your Benchmark Period,you must complete a Missing Tax or Pay Period Earnings Documentation Sworn Written Statement (SWS-9). CATEGORY III CAREER CHANGER OR LESS THAN 12 MONTHS
Submit the Tax Documents and Pay Period Documents for 2010 as described in Category I/II. For Category III, you must include documents for 2011. If you were not working in 2011 and do not have the Tax Documents and Pay Period Documents for at least 90 consecutive days in the 2011 Benchmark Period, you must submit documents showing your status in 2011 such as: 1. Documents showing you were a full-time student from the educational institution; 2. Documents showing you were involuntarily unemployed including job search efforts or unemployment compensation records; 3. Documents showing you took leave under the Family Medical Leave Act; 4. Documents showing you were temporarily or permanently medically incapacitated from your doctor or employer or 5. Documents showing you were a full-time parent, guardian, volunteer or missionary.
CATEGORY III NEW ENTRANT Submit the same documents as needed for Category III Career Changer or Less than 12 Months as well as: 1. A dated lease, sublease or utility bill showing your address on April 20, 2010, or the address of where you planned to live if the Spill had not occurred. 2. A Sworn Written Statement (SWS-12), letter or contract for employment completed by your employer stating when you received the offer of employment, when you accepted the offer of employment and your anticipated (and actual if you started work) start date of employment. CATEGORY IV Submit Claimant Sworn Written Statement (SWS-7) and Employer Sworn Written Statement (SWS-8) describing your employment history,whether the DWH Spill caused your losses, the amount of those losses and information about your employer including contact information. BASE YEAR OPTIONS The period used for historical comparison of your earnings. If you are Category I/II or IV, your Base Year(s) must include 2009 but can also include an average of the following: 2008 and 2009; or 2007-2009. If you are Category III, your Base Year(s) must include 2011, but may require 2009 if you are a Category III Career Changer who did not work in 2011. ALL CATEGORIES Submit Sworn Written Statement (SWS-12) connecting your losses to the Spill if the place where you worked is located in Zones B (and is not a Tourism business), C or D and is not an Eligible Employer. An employer is not an Eligible Employer if it did not receive an offer of payment in the Gulf Coast Claim Facility and has not established causation in the DWH Program.
