Notification for interested buyers of land
The Rama Territorial Government (GTR) makes public, that according to
Law 445 of January 2003, “Communal Property Right of the Indigenous Peoples andEthnic Communities in the Autonomous Regions of the Atlantic Coast of Nicaragua andthe Rivers Bocay, Coco, Indio and Maíz”,
In line with Law 28 of October 1987 “The Regional Autonomy Regime of the AtlanticCoast of Nicaragua”The Nicaraguan State recognizes the ownership to the indigenous and ethnic communitiesof the land they occupy traditionally.A consequence of this legislation is that:The colonist or third parties that have been living in the territory more than 10 years arewelcome to stay because they have been living there peacefully together with the Ramawithout negotiating land or compromising our rights, like they have also preserved naturalresources and our environment. See the Rama Politic on Third Party Occupancy in theRama TerritoryLikewise we would like to remind the public in general and in particular lawyers, judgesand public registration offices involved in land transactions that, according to law 28,indigenous lands have been illegal to sell and buy since 1987.That since the promulgation of Law 445 in 2003, no Transitory Titles (Títulos Supletorios)nor titles based on the Agriculture Reform Legislation can be given in indigenous or ethnic peoples’ land. (Law 445 article 71).We therefore recommend national and international interested buyers to be extremelycareful if they are being offered to buy property right that is based on that kind of titles andlocated in the traditional Rama Territory (or any indigenous land). Otherwise you run therisk to get involved in a land conflict with our Territorial Government and will loose themoney invested.The Rama Territorial Government also ask the Regional and Municipal authorities to ceasemotivating colonists to migrate into the Rama Territory which are at the same time
