STATE DEFENDANTS’ MO
TION FOR SUMMARY JUDGMENT
Defendant Michigan Governor Rick Snyder and DefendantMichigan Attorney General Bill Schuette
(collectively “StateDefendants”) move for summary judgment under Fed
eral Rule of CivilProcedure 56.
Under Rule 56(c), “summary judgment is proper ‘if the
pleadings, depositions, answers to interrogatories, and admissions onfile, together with the affidavits, if any, show that there is no genuineissue as to any material fact and that the moving party is entitled to a
judgment as a matter of law.’”
Celotex Corp. v. Catrett
, 477 U.S. 317,322 (1986). On August 12, 2013, State Defendants sought concurrencepursuant to Local
Rule 7.1(a) from Plaintiffs’ counsel, which was
denied, necessitating this motion. For the reasons set forth below, StateDefendants request that this Court grant their Motion for SummaryJudgment.Respectfully submitted,Bill Schuette Attorney General/s/Kristin M. HeyseTonya C. Jeter Attorneys for State Defendants

It is interesting that the state is citing Baker v. Nelson as good law. By contrast, when Texas filed its post-Windsor briefs in the Texas cases, it disd not cite Baker.
