BOARD OF CHOSEN FREEHOLDERS – JULY 10, 2013
A regular meeting of The Board of Chosen Freeholders of the County ofMorris, State of New Jersey, was held on July 10, 2013, in the FreeholderPublic Meeting Room, Administration & Records Building, Morristown, NewJersey. The meeting began at 8:00 p.m.Clerk of the Board Diane M. Ketchum announced that adequate notice ofthis regular meeting held the 10th day of July, 2013 has been providedthrough resolution adopted by this Board at its Regular Meeting held at theAdministration and Records Building on January 4, 2013, and by electronicmailing to the Star Ledger, the Daily Record, and the Record through postingon the County website and by filing a copy of same with the Morris CountyClerk and the Clerk of this Board.
ROLLCALL 
PRESENT: Freeholders Douglas Cabana, John Cesaro, Ann Grossi,Hank Lyon, John Krickus and Director Thomas Mastrangelo(6)ABSENT: Freeholder David Scapicchio (1)ALSO PRESENT: Administrator John Bonanni, Assistant CountyAdministrator Mary Jo Buchanan, Assistant County CounselRandy Bush, and Clerk of the Board Diane M. All Work Session Meeting Minutes and Executive Session MeetingMinutes from June 26, 2013.On motion by Freeholder Cesaro and seconded by Freeholder Grossi,the work session, and executive work session meeting minutes wereapproved.--
COMMUNICATIONS
1.Mendham Patriots Basketball is asking permission to hang a banneracross County Route 510 in Mendham Township from August 1 to August 12to advertise registration.2.The Borough of Mendham is asking permission on behalf of the RecreationCommittee to close a portion of County Route 510 from 9 a.m. to 12 noonfor the parade on Labor Day, September 2.3.The Dover Renaissance Five Kilometer Run Race is asking permission toclose off portions of Blackwell and South Salem Streets in Dover onSaturday, November 2 from 8:30 a.m. to 9:45 a.m.On motion by Freeholder Cabana and seconded by Freeholder Lyon, therequests were approved.--

(1)Director Mastrangelo stated: “We will now consider the introduction bytitle an ordinance.”Freeholder Grossi stated: “I would like to introduce by title anordinance entitled, ‘CAPITAL SURPLUS ORDINANCE APPROPRIATING $76,000FOR THE PURCHASE OF A MAPS VEHICLE IN THE DEPARTMENT OF HUMANSERVICES.’”

(1)Director Mastrangelo stated: “We will now consider for finaladoption the ordinance entitled ‘BOND ORDINANCE OF THE COUNTY OFMORRIS, NEW JERSEY, APPROPRIATING $1,414,800 AND AUTHORIZING THEISSUANCE OF $1,346,000 BONDS OR NOTES OF THE COUNTY FOR ROADWAY DESIGNAND CONSTRUCTION PROJECTS, BY AND FOR THE COUNTY OF MORRIS, NEW JERSEY.”Clerk Ketchum read the following ordinance:BE IT ORDAINED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTYOF MORRIS, NEW JERSEY AS FOLLOWS:

BE IT ORDAINED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OFMORRIS, NEW JERSEY (not less than two-thirds of all the members thereofaffirmatively concurring), AS FOLLOWS:Section 1.The improvements described in Section 3 of this bondordinance are hereby respectively authorized as improvements to be made oracquired by the County of Morris, New Jersey (the “County”). For the saidimprovements or purposes stated in said Section 3, there is herebyappropriated the sum of $1,414,800, said sum being inclusive of allappropriations heretofore made therefor and including the sum of $68,800 asthe down payment for said improvements or purposes required by law or moreparticularly described in said Section 3 and now available therefore byvirtue of provision in the previously adopted budget or budgets of the Countyfor down payments or for capital improvement purposes.Section 2.For the financing of said improvements or purposes and tomeet the part of said $1,414,800 appropriation not provided for byapplication hereunder of said down payment, negotiable bonds of the Countyare hereby authorized to be issued in the principal amount of $1,346,000pursuant to the Local Bond Law of New Jersey. In anticipation of theissuance of said bonds and to temporarily finance said improvements orpurposes, negotiable notes of the County in the principal amount notexceeding $1,346,000 are hereby authorized to be issued pursuant to andwithin the limitations prescribed by said Law.Section 3.(a)The improvements hereby authorized and the purposesfor the financing of which said obligations are to be issued are for thedesign, construction and rehabilitation of the County roadway systemincluding, but not limited to, Parsippany Road in Hanover Township andParsippany Township, Boulevard in Pequannock, Green Pond Road in RockawayTownship, Bartley Road in Mt. Olive Township, Park Avenue in Morris Township,Ridgedale Avenue in East Hanover, West Hanover Avenue in Randolph Township,Main Road / Changebridge Road in Montville, and East Hanover Avenue inHanover, including all work and materials necessary therefor and incidentalthereto (all as shown on and in accordance with the plans and specificationstherefor on file in the office of the Clerk of the Board of ChosenFreeholders and hereby approved).(b)The estimated maximum amount of bonds or notes to be issued forsaid purposes is $1,346,000.(c)The estimated cost of said purposes is $1,414,800 which amountrepresents the initial appropriation made by the County. The excess of theappropriation of $1,414,800 over the estimated maximum amount of bonds ornotes to be issued therefor being the amount of said $68,800 down payment forsaid purposes.Section 4.The following matters are hereby determined, declared,recited and stated:(a)The said purposes described in Section 3 of this bond ordinanceare not current expenses and are each a property or improvement which theCounty may lawfully acquire or make as general improvements, and no part ofthe cost thereof has been or shall be specially benefited thereby.(b)The period of usefulness of said purposes within the limitationsof said Local Bond Law and according to the reasonable life thereof computedfrom the date of said bonds authorized by this bond ordinance, is 20 years.(c)The supplemental debt statement required by said Law has beenduly made and filed in the office of the Clerk of the Board of ChosenFreeholders and a complete executed duplicate thereof has been filed in theoffice of the Director of the Division of Local Government Services in theDepartment of Community Affairs in the State of New Jersey (the “Division”),and such statement shows that the gross debt of the County as defined in saidLaw is increased by the authorization of the bonds and notes provided for inthis bond ordinance by $1,346,000, and the said obligations authorized bythis bond ordinance will be within all debt limitations prescribed by saidLaw.(d)An aggregate amount not exceeding $500,000 for interest on saidobligations, costs of issuing said obligations, engineering costs and otheritems of expense listed in and permitted under Section 40A:2-20 of said Lawis included in the estimated cost of said improvements.Section 5.Any funds from time to time received by the County ascontributions-in-aid of financing the improvements or purposes described in
