In this unpublished decision, the Board of Immigration Appeals (BIA) reopened proceedings sua sponte upon finding it incorrectly concluded in a prior decision that the respondent, rather than her mother, made a material misrepresentation that required her to obtain a waiver of inadmissibility under Section 212(i). The decision was written by Member Neil Miller.

The respondent gued that se never made amaterial misrepresenttion that required her to qali r te waiver.The Boad's decisionund tat e anscipt showed the respondent admitted te misrepresentaton durng her testimony. However, te Boards decision relied on an incorrect citation to the testimony of therespondent's mother (Tr. at 315) who eventually wthew er application and acceptedvoluntary depature. The respondent's case was severed om her mothers case and a newearingwas set (Tr. at 47) Because the Boads na order reied on a incorrect ctual nding,we wil vacate tat orderuermore, te record shows that te mmiation Judge did not sucienty explain whyte respondent was inadmissibe under section 212(a)(6)(C) of te Act, and therere needed asection 212(i) waiver to adjust her satus.
