Dear High Commissioner Pillay: Please accept instant letter, the attached records (Table 1 and Table 2, [1]), and records, which were filed by me with the UN UPR Office, [2] as request for protection of a Human Rights activist in Israel. 1) Threats in the United States April 2010 Prior to the deadline for the 2010 UPR of the United States (April 2010) and after I sent my draft report to US authorities, per the UNHRC UPR protocol, I started getting threats in the United States, where I resided for many years (as a dual citizen - US and Israel). Initially, the threats were by unauthorized individuals. However, towards the deadline for the submission, I was called by the US Marshals Threat Unit for an Interview. I ignored the threats and submitted my report, which was later incorporated into the 2010 UPR Professional Staff Report for the USA with the note corruption of the courts and the legal profession and discrimination by law enforcement in California. A few days after the deadline, I was informed by my neighbors that armed Federal agents arrived at my home and appeared eager to shoot. My neighbors urged me to turn myself in for fear to their own safety, if shooting will ensue. I immediately took some cash, left all my possessions behind, and escaped from the United states to Israel. 2) Retaliatory actions in Israel January 2013 In Israel, I continued my Human Rights activity, and as was the case in the United States, focused on integrity of the justice system. In 2012, I started receiving threats from my bank in Israel that my bank accounts would be seized, purportedly on behalf of the United States, although no legal process had been initiated, either in the US or in Israel against me. Regardless, I filed my submission, which was eventually incorporated into the UPR Professional Staff Report for Israel with the note, lack of integrity in the electronic records of the supreme court, the district courts and the detainees courts in Israel. On January 1, 2013, my bank accounts in Israel were seized with no legal process at all.

All my efforts to gain equal protection through the Israeli authorities failed. However, as soon as I entered Israel in 2010, I sought and gained German citizenship. I therefore petitioned for protection by the German Consul to Israel, and only then my bank accounts were returned to my possession. 3) Retaliatory actions in Israel August 2013 Regardless, I continued my my Human Rights activity, including the initiation, with others, of a petition, calling upon the Israeli Attorney General to instruct the Israel Police to conduct criminal investigation against the Tel Aviv District Court. The petition pertains to allegations of obstruction of justice with impunity in the case of self-immolated, social protest activist Moshe Silman. [3] To this date, the petition has been signed by over 100 people, including a number of Israeli attorneys. I have also discussed conditions in the Israeli courts with former Israeli Minister of Justice Prof Daniel Friedman and former Israeli National Security Adviser Giora Island. Both of them advocate reform of the court system in Israel. Both of them have also showed interest in my original work in this area, which is based on analysis of the new computer systems in the courts, not on legal analysis. As detailed in the attached records (Table 1 and 2), I am now named Respondent (Defendant) in a court process in the Haifa Magistrate Court, where: a. No summons was ever issued or served on me; b. No court record spelled out the section of the law, based on which I was purportedly sued; c. No court record, which was served on me, spelled out the names of the parties to the litigation; d. Court decisions were served (when served at all) unsigned by the judge and accompanied by unsigned authentication letters by an unnamed clerk; e. The Chief Clerk of the Court refused to certify any of the judicial records in this case True Copy of the Original; f. Request for exemplary punitive measures against me is now purportedly pending, which failed to state the section of the law, based on which such punitive measures are to be imposed, [4,5] and g. I am denied access to the court records in the same court file, where I am purportedly sued. A reasonable person, upon review of the facts in this matter would surely conclude that the Haifa Magistrate Court is engaged in a sham court procedures and in serious violation of my Human Right for Fair Hearing/Due Process. The matter should be viewed as particularly serious, since Counsel for the Israeli Attorney General is party to the sham procedures. My attempts to protect my rights in this matter through State of Israel authorities of all three branches of government have failed. Accordingly, I am concerned of immediate consequences. 4) Request for protection by the UN High Commissioner Therefore, I ask protection by the Honorable Navanethem Pillay, UN High Commissioner for Human Rights against potential unlawful abuse of my rights:

a. Denial of my right for possession through taking of my money again; b. Denial of my right to travel, and c. Denial of my liberty - I may be falsely imprisoned. It should be emphasized that I have no expectation of correction of the wrongs done by the Court in the underlying matter (fraud), only protection against unlawful retaliation for my whistle-blowing actions. Time is of the essence, since the Haifa Magistrate Court scheduled a hearing in this matter for September 17, 2013. Table 1 Summary of Evidence of the Conduct of Sham Litigation in the Haifa Magistrate Court in re: Conservatee Rivca Shami Zernik (1829-06-10 and 25607-03-13) In the early 2000s, while I was still residing in the US, my elderly mother started showing signs of senility. In 2005, she was diagnosed as Alzheimer's Disease patient. Regardless, no legal action was initiated to designate her legally incompetent, and as it turned out years later, during these years my father and my brother executed various legal records in her name. On June 1, 2010, five weeks after I escaped to Israel, legal action was filed for designating my mother legally incompetent and appointing a conservator. Initially, attempt was made to keep this court action secret from me and from her brother, my uncle, with whom I was staying at the time (according to Israeli law, all first degree relations had to be noticed). Eventually, I learned about this action, and during the following couple of years, my suspicions grew that such action was directed against me. Therefore, in December 2012, I filed request to inspect the respective court file in the Haifa Magistrate Court, and I gained partial access. Review of the records affirmed my suspicions. False and deliberately misleading records were discovered, which were biased against me, starting with the commencing record, which stated that I was nowhere to be found, and therefore, could not consent to the process. Regardless of my efforts, the Court refused to correct any of the false and deliberately misleading records. Moreover, once I discovered the records, the Court initiated actions, which are inconsistent with any notion of Fair Hearings: The original court file was declared closed, and a second court file was purportedly commenced on the same matter. In the second court file, I was purportedly named Respondent (Defendant), but no summons was ever issued, and no law of the State of Israel was indicated as the foundation for such action. I am not permitted to inspect the court file records in either court file. Some of the Court's decision were not served on me, the purported Respondent, and I am not permitted to inspect them, even after repeated requests. Neither am I permitted to inspect the list of decisions (docket). To this date, all judicial records, which have been served on me were unsigned by the judicial authority and were accompanied by unsigned authentication letters by an unnamed Clerk. The Chief Clerk of the Court has refused to certify any of the court records in these court files True Copy of the Original. It should be noted that I have never appeared in court in person, neither through an attorney under either court file. Instead, I have repeatedly filed papers, indicating the false and misleading nature of the Court's actions, and consequent disqualification of the court. A reasonable person, upon review of the records, will surely conclude that the Haifa Magistrate Court and others were and are engaged in the conduct of sham litigation in this matter, in violation of key articles of the Universal Declaration of Human Rights. Once I advertised the nature of the Court's conduct, request was filed for exemplary punitive actions against me, now purportedly pending before the Court. split one matter into two court file numbers, out of compliance with the law, [2] and regardless of opinion to the contrary by Counsel for State Attorney. [3] 2) After opening the second court file, Judge Alon refused to correct or address any of the false records, which were filed under the first court file, which she claims closed. information was most likely fed to the social worker by others, and the social worker did not verify these facts. For example: a) That Dr Joseph Zernik has just arrived in Israel (in fact he was living in Israel for six months by then, and b) That the Conservatee caught Alzheimer's Disease in 2005. In fact, she had shown various signs of senility since the early 2000's, but final diagnosis of Alzheimer's Disease was made only in 2005. 2) The Court refused to correct such false and misleading record, even after it was discovered and its falsehood was pointed out to the Court. Verbally, Counsel informed Dr Joseph Zernik that they did not intend to address his claims of Fraud on the Court in instant court files. 2) Request for corrective actions relative to similar conditions in the Tel Aviv District Court and the Supreme Court were filed with the State Attorney General. Table Summary No 2 Court file and related records of the Haifa Magistrate Court in re: Conservatee Rivca Shami Zernik (1829-06-10 and 25607-03-13) In the early 2000s, while I was still residing in the US, my elderly mother started showing signs of senility. In 2005, she was diagnosed as Alzheimer's Disease patient. Regardless, no legal action was initiated to designate her legally incompetent, and as it turned out years later, during these years .my father and my brother executed various legal records in her name On June 1, 2010, five weeks after I escaped to Israel, legal action was filed for designating my mother legally incompetent and appointing a conservator. Initially, attempt was made to keep this court action secret from me and from her brother, my uncle, with whom I was staying at the time .((according to Israeli law, all first degree relations had to be noticed Eventually, I learned about this action, and during the following couple of years, my suspicions grew that such action was directed against me. Therefore, in December 2012, I filed request to inspect the respective court file in the Haifa Magistrate Court, and I gained partial access. Review of the records affirmed my suspicions. False and deliberately misleading records were discovered, which were biased against me, starting with the commencing record, which stated that I .was nowhere to be found, and therefore, could not consent to the process Regardless of my efforts, the Court refused to correct any of the false and deliberately misleading records. Moreover, once I discovered the records, the Court initiated actions, which are inconsistent :with any notion of Fair Hearings The original court file was declared closed, and a second court file was purportedly commenced on the same matter. In the second court file, I was purportedly named Respondent (Defendant), but no summons was ever issued, and no law of the State of Israel was indicated as the foundation for such action. I am not permitted to inspect the court file records in either court file. Some of the Court's decision were not served on me, the purported Respondent, and I am not permitted to inspect them, even after repeated requests. Neither am I permitted to inspect the list of decisions (docket). To this date, all judicial records, which have been served on me were unsigned by the judicial authority and were accompanied by unsigned authentication letters by an unnamed Clerk. The Chief Clerk of the Court has refused to certify any of the court records in these court files True Copy of the Original. It should be noted that I have never appeared in court in person, neither through an attorney under either court file. Instead, I have repeatedly filed papers, indicating the false and misleading nature .of the Court's actions, and consequent disqualification of the court A reasonable person, upon review of the records, will surely conclude that the Haifa Magistrate Court and others were and are engaged in the conduct of sham litigation in this matter, in violation .of key articles of the Universal Declaration of Human Rights Once I advertised the nature of the Court's conduct, request was filed for exemplary punitive actions against me, now purportedly pending before the Court. # 1.
