In this unpublished decision, the Board of Immigration Appeals (BIA) upheld an order of removal against a lawful permanent resident admitted to the country in 1975 who later served as a corporal in the Marine Corps. The Board stated that it could not consider the respondent's argument that removing him from the country constituted a disproportionate penalty in violation of the Due Process Clause. The decision was written by Member Anne Greer.
