ORDER: This matter is presently before the Board pursuant to a February I, 2013, order of the United States Court of Appeals for the Ninth Circuit. The Court remanded this matter to us for further consideration of the respondent's motion to reopen his removal proceedings. Considering the

totality of the circumstances presented in this case, we will reopen these proceedings pursuant to our sua sponte authority under 8 C.F.R. 1003.2(a). The proceedings are reopened, and the

record is remanded to the Immigration Judge for further consideration of the respondent's eligibility for adjustment of status, as well as any other relief from removal that he may seek. In remanding this matter, we express no opinion as to the outcome of this case.
