MEDIA RELEASE FOR IMMEDIATE RELEASE AUGUST 30, 2013

On August 22, 2013 the Chillicothe Police Dispatcher was contacted by employee Tamra Lowe at the City of Chillicothe Administration Building reporting a situation occurring in her office involving Police Chief Roger Moore. A unit was dispatched and I was made aware of the situation immediately thereafter. Due to the nature of the claims, I began an investigation immediately. On August 30, 2013 I concluded my investigation of the incident and concur with the findings of the agency investigation that there was no criminal activity. The Administrative investigation however reveals potential infractions for Chief Moore regarding insubordination and failure to carry out proper work directive. During a prior incident on March 16, 2013 and respective resolution of April 10, 2013, it was noted in the documentation placed in Chief Moores file: The events of that eveningplaced the City and its employees in a very negative light, and cost us many hours of distracted work. Chief Moore has been counseled, and has agreed with my view that he must not place himself in a position that will bring negative attention to the Department or the City of Chillicothe. The actions of Chief Moore on August 22, 2013, created a situation which has again escalated to a situation that has brought negative attention to both the City of Chillicothe and the Chillicothe Police Department. More importantly, it is embarrassing to the citizens of this community. As Mayor, I cannot allow this type of activity to continue within my administration, especially by staff members. All city employees work for the taxpayers of Chillicothe and we are expected to perform our jobs with the highest of integrity and in the best interest of the taxpayers. It is my intent to ensure that happens. According to Policy Memorandum No. 3-98, Rev. 1 EMPLOYEE PERFORMANCE EXPECTATIONS, the act of insubordination and the respective penalty are indicated as CODE O in the City of Chillicothe Employee Expectation Policy Performance Failure List. The work directive violated by Chief Moore is a first violation of the instructions given to Chief Moore on April 10, 2013 and carries a penalty of a 1-day suspension without pay according to the TABLE OF CONSEQUENCES. A request for a Pre-Deprivation Hearing as required under Civil Service rules has been offered and will be arranged if accepted concurrent to this press release. At the conclusion of the Pre-Deprivation Hearing and if no satisfactory response from Chief Moore, the suspension will be carried out. Any further incidents of insubordination will result in a three (3) day suspension without pay or termination of employment if warranted.
