A new Sec. 402 is inserted to read as follows:

D.C. Official Code § 23-1322(c) is amended to read as follows:

(a) By striking the phrase “substantial probability” and inserting the phrase “probable cause” in

its place.”.

with the remaining subsections re-lettered accordingly.

Rationale:

This amendment would allow for “probable cause” to be the pre-trial detention standard.

Fiscal Impact:

There is no fiscal impact to the amendment beyond that of the underlying legislation.
