the Petitioner, Laura M. Huff, having filed a petition by way of anOrder to Show Cause with this Court on April 7, 2009, regarding a modification of custody for the minor child,
Taylor J. Szczypinski (D.O.B. 01/06/1994)
, and the matter having come on for an appearance, with the Petitioner appearing personally and with her attorney, George F. Newton, Esq., and Respondent appearing personally and with hisattorney, Paul B. Watkins, and the minor child appearing through the Attorney for theChild, Donna M. Cathy, Esq., and the parties having reached an agreement as to allissues.
NOW, THEREFORE
, upon hearing each of the respective parties, and upon themotion of the Attorney for the Child, and
AFTER 
the Court having searched the statewide registry of orders of protection,the sex offender registry and the Family Court’s child protective records, and havingnotified the attorneys and the parties of a finding of an outstanding order of protectionissued against the Petitioner, for the benefit of the Respondent, out of the Town of SenecaCourt which expires on July 3, 2009, it is hereby Huff –against- SzczypinskiDonna M. ORDERED
, that the parties shall share joint legal custody of the minor child, andit is further 
ORDERED
, that the parties shall share periods of physical placement of theminor child as follows:1.During the Summer:the Petitioner shall have periods of placementMondayat 9:00 a.m.through Fridayat 6:00 p.m. beginning June 22, 2009 and the Respondent shall have periods of placement on the weekends fromFriday at6:00 p.m. through Monday at 9:00 a.m.;2.During the School Year: the Respondent shall, subject to the provisionherein,have periods of placement Mondayat 9:00 a.m. through Friday at 6:00 p.m. beginning on the Monday after Labor Day, and the Petitioner shall have periods of placement on the weekends from Friday at6:00 p.m.or otherwise after school activities through Monday at 9:00 a.m.; as longas the relationship between the Respondent and child has improved and inthe event that it has not then all parties agree that this will constitute achange of circumstances to warrant the filing of a petition for a change of this placement period;3.That this schedule is met to be flexible to allow the minor child theopportunity to spend time with one parent or the other outside the periodsof placement as the parties can agree but with preference given to theminor child’s requestsand schedule, and it is further

,that transportation for visitation will be that the minor child will betransported from her placement at the time of visitation by the parent whose period of visitation is being exercised, unless otherwise agreed to by the parties, andit is further 
ORDERED
, that the parties shall have reasonable and liberal telephone contactwith the minor child when the child is with the other party, and it is further 
ORDERED
, that the parties may contact each other by telephone concerningvisitation arrangements for the minor child, and it is further 
ORDERED
, that both parties shall be allowed to attend school functions andother activities involving the minor child, and it is further 
ORDERED
, that the appointment of the Attorney for the Child shall remain ineffect until September 4, 2009, and it is further
