FAMILY COURT & YOUTH JUSTICE COMMITTEE fone RECEIVED Mayor Bk feed SUN 15 2009 20338 ~65 Avenue Langley BC MAYOR'S OFFICE. ‘Re:__ South Fraser Family Court & Youth Justice Committee Terms of Reference Dear Mayor Green; ‘As you may be aware the South Fraser Family Court & Youth Justice Committee is a committee with ‘membership ffom the Corporation of Delta, City of Langley, Township of Langley, City of Suney and City of White Rock. ‘The commitee is mandated by the Attomey General, and the five municipalities have ereated ‘Terms of Reference over and above that of the Attomey General. As such, all five member mun‘ipalites must adopt changes to the Terms of Reference inorder for them tobe ratified. In 2004 the only municipality that did not adopt a change to the Terms of Reference was the Corporation of | Delta, however they did act on the suggested change. The Committee suggested further changes to the Terms of Reference in 2008, however these were not adopted by the five municipalities. ‘The committee suggested ‘additional changes in 2009, and these were also not adopted by all five Councils. ‘Asa result of the above history, it was agreed to revert to the Terms of Reference adopted in 2004, and that the committee make further recommended changes, and these be sent for adoption to the five member ‘municipalities. ‘Therefore the following recommendation was made at the June 4,2009 meeting; THAT the commitee revert to the 2004 Terms of Reference (ratified by all five member municipal Councils); AND THAT the five member municipal Councils be requested to adopt a revision to the Terms of Reference to allow for the appointment of one Council member from each municipality to the Committee with voting rights. 2 iagley & Se. wiley =p Tecemeiont ay of White Rck Cayo Wie Rc, 2 Ba Ve Aue, Wi BOBS A history of events relating to the changing of the Terms of Reference is attached so thatthe five Councils can "understand events that led to the changes to the Terms of Reference, and how they were dealt with by the five Councils. Also attached is the 2004 Committee Terms of Reference. Delta - Did not adopt Minutes, however did appoint members to the Committee City of Langley ~ Adopted Langley Township ~ Adopted Surrey ~ Adopted ‘White Rock — Adopted February 2008 ‘The Committee made a resolution to add “one Councillor member from each municipality o the committee, all ‘with voting rights and deleted the line:"but only Members appointed by municipal Council may vote on issues coming before the Committee.” Delta Received January & April, but not February City of Langley ~ Received and adopted January & Mar, but not February Langley Township — Received February Minutes Surrey ~ Received December & march, but not January or February ‘White Rock ~ Received January & March, but not February February 2009 ‘The Committee made a resolution “THAT that Terms of Reference be amended to exclude Councillors on the Committee from voting and to act only as liaison members.” Delta - wrote tothe Attorney General looking for clarification on this issue City of Langley ~ Adopted February Minutes Langley Township - wrote to the Attomey General looking fo clarification on this issue Surrey ~ wrote to the Attorney General looking for clarification on this issue ‘White Rock ~ Adopted February Minutes ‘The Terms of Reference from 2004 with the addition of Delta to the committee should be the last “correct” ‘Terms of Reference. | propose to take the 2004 Terms of Reference, incorporate the changes proposed by the Committe in 2009 and 2009, and re-send to the five member municipalities for edoption, along with the history above, so that the ‘Terms of Reference will be current and adopted by all.
