EDUCATIONUNIVERSITY OF NAMIBIA ACT 18 OF 1992

ACTTo establish the University of Namibia and to provide for its administration andcontrol of affairs, for the regulation of its activities and for matters incidental thereto.

1 Definitions
In this Act, unless the context otherwise indicates-
"academic staff"
means-
(a)
all those persons employed by the University whose conditions of employment include theobligation to undertake teaching or research;
(b)
the Librarian appointed in terms of section 13
(c)

(c)
any incumbent of a post declared by the Council to be an academic post;
"academic year"
means the academic year of the University as prescribed;
"administrative staff"
means all those persons employed by the University who are notacademic staff;
"Chancellor"
means the Chancellor of the University elected in terms of section 6(1);
"Council"
means the Council of the University referred to in section 9;
 
 
"Minister"
means the Minister of Education and Culture;
"prescribed"
means prescribed by statutes or regulations framed under section 25;
"Pro-Vice-Chancellor"
means a Pro-Vice-Chancellor of the University appointed under section 8(1);
"Senate"
means the Senate of the University referred to in section 10;
"Students' Representative Council"
means the Students' Representative Councilreferred to in section 15(1);
"the University"
means the University of Namibia established by section 2;
"this Act"
includes the statutes and regulations;
"Vice-Chancellor"
means the Vice-Chancellor of the University appointed in terms of section 7(2).
2 Establishment and seat of the University
(1) There is hereby established a university to be known as the University of Namibia.(2) The seat of the University shall be at Windhoek.
3 Status and proprietary capacity of the University
(1) The University shall be a juristic person capable in law of suing and being sued in itsown name and shall have the power, subject to this Act, of purchasing or in any other manner acquiring, holding, hiring, letting, selling, exchanging or otherwise alienating anymovable or immovable property, of granting to any person a real right in or servitude on itsproperty and of investing, lending or borrowing money.(2) The University may receive money or property by way of donation or bequest or in trustand may control, use or administer it or deal with it in any other manner subject to thoseconditions, if any, of the donation, bequest or trust which are consistent with the aims of theUniversity.
4 Aims of the University
The aims of the University shall be to provide higher education, to undertake research, toadvance and disseminate knowledge, to provide extension services, to encourage thegrowth and nurturing of cultural expression within the context of the Namibian society, tofurther training and continuing education, to contribute to the social and economicdevelopment of Namibia and to foster relationships with any person or institution, bothnationally and internationally.
5 Constitution of the University
The University shall consist of-
(a)
a Chancellor;
(b)
a Vice-Chancellor;
(c)
such Pro-Vice-Chancellors as may be appointed by the Council in terms of section 8(1);
(d)
a Council;
(e)
a Senate; and
(f)
the academic and administrative staff, and students of the University.
 
6 Chancellor of the University
(1) The Chancellor of the University shall be the titular head of the University and shall beelected by the Council in the prescribed manner.(2) The Chancellor shall have the right to confer or grant degrees, diplomas, certificatesand other awards and distinctions of the University and to perform such other functions asmay be prescribed.(3) The Chancellor shall hold office for a period of six years and shall be eligible for re-election at the expiration of his or her term of office.(4) Upon the death or resignation of the Chancellor, the Council shall as soon as possibleelect a new Chancellor.
7 Vice-Chancellor of the University
(1) The Vice-Chancellor of the University shall be the chief academic and administrativeofficer of the University.(2) The Vice-Chancellor shall be appointed by the Council in the prescribed manner onconditions of employment and privileges deterrnined by the Council.(3) The Vice-Chancellor's powers, duties and functions shall be as prescribed.(4) The Vice-Chancellor shall hold office for a period of six years and shall be eligible for re-appointment at the expiration of his or her term of office.(5) The Vice-Chancellor may from time to time designate any person in the employment of the University to serve, in any particular case or for such period as he or she may determine,in his or her place as a member of any committee referred to in section 9(9), 10(8) or 11 andto perform the duties and functions and exercise the powers connected therewith.
8 Pro-Vice-Chancellors of The University
(1) The Council may appoint one or more persons as Pro-Vice-Chancellors of theUniversity.(2) The conditions of employment, privileges, period of office, powers, duties and functionsof a Pro-Vice Chancellor shall be determined by the Council.(3) The Vice-Chancellor may from time to time delegate to a Pro-Vice-Chancellor any of his or her powers, but shall not be divested of a power so delegated.
9 Council of the University
(1) Subject to this Act, the government and executive authority of the University shall bevested in the Council of the University.(2) Subject to subsection (3), the Council shall consist of-
(a)
the Vice-Chancellor;
(b)
such Pro-Vice-Chancellors as may be appointed in terms of section 8(1);
(c)
not more than six persons appointed by the President of the Republic of Namibia;
(d)
four members of the Senate appointed by the Senate;
