Appeals Court Clears Deck: Levels NewCharge Against Former BusinessmanThe American Businessman “Benie” Madoff,who recently pleaded guilty to an 11-countcriminal complaint that he defraudedinvestors of billions of dollars over a twentyyear period has been set free by an appealscourt. In a highly controversial decision, alleleven charges against Mr. Madoff have beendropped by an appeals court judge and Mr.Madoff’s six million dollar New York Penthouse has been returned to him by theU.S. Government. However the court orderedMr. Madoff to appear in court in 2 monthstime to face prosecution on a newGovernment charge.According to government lawyers there isevidence that in 1976, a week before Mr.Madoff launched his largest investment fund,Mr. Madoff tricked government guards intoletting him into the Office of Managementand Budget in Washington DC and, when thesecretary staff went on a lunch break, Mr.Madoff headed towards a Xerox machine witha document he had lifted off a bookshelf,
 
and, quickly copied the operations manualfor the Goverment's Social Security system.Mr. Madden has denied this charge andstated that even if it were true that neitherhe, nor anyone with his background, had theability to read such a manual.Mr. Madoff’s lawyer was quoted as saying hisclient had told him:“The Social Security Operations manual islike any other government document. Itmakes sense only to people who have tenyears of Federal Government experience orto people who complain when a documenthas a chart with less than six footnotes.However I am sure it would read well tosomeone who can speak “acronym” in fivelanguages.”Government Lawyers responded with thefollowing comment:“In admitting he could not read the SocialSecurity operations manual it is clear that Mr.Madoff, at one time, had the manual in hispossession and did indeed read it, or somecopy of it.”Mr. Madoff's lawyer responded. “TheGovernment has no case. If a person does nothave the ability to read a Social Securityoperations manual then that person can notbe accused of having read it.”
 
When met with silence Mr. Madoff’s lawyeradded:“If my client were blind you could not accusehim of lurking in suburban hedges andpeeping into Tom type bedrooms.”Government Lawyers responded by sayingthat Mr. Madoff’s case would not hold up incourt since there is ample evidence thatBraille readers are available at FederalGovernment offices and could be used toread stolen documents.
