Fictitious Person
“And thou shalt make a plate of pure gold, and grave upon it, like the engravings of a signet, HOLINESS TO YAH” (Exodus 28:36)Yes, reader, you have read correctly; I havebeen “sued by a fictitious person.” That is, I am a natu-ral person, a real human being with thoughts, feelings, conscience, mind, body, and spirit. My major adver-sary in the instant lawsuit is “a fiction,” a mere“creation of law,” a “man-made fable,” accorded bylaw the rights of natural persons, along with immortal-ity – the General Conference Corporation – “a legalentity formed to hold title to General Conference as-sets, to serve the General Conference in carrying outit’s purposes, and to receive gifts and legacies for theGeneral Conference unincorporated (or the spiritualChurch).” Joining as co-plaintiff with said creature of law is the Church – its administrative body taking re-sponsibility, and referred to in the complaint as “an un-incorporated association, [representing] the interests of the . . . Church.” History reveals in the early 13th cen-tury Pope Innocent IV developed the concept of a cor-poration as a personae fictae, – a fictitious person – oran artificial person, that was created and controlled bypapal authority. This led to the legal separation of anartificial person – a "corporation" from a natural per-son – a human being. (John Dewey, “The HistoricBackground of Corporate Legal Personality,” Yale LawJournal, Vol. XXXV, April 1926, pages 655-673)Now, you may ask, what is so incredible about this sce-nario? Well, you pose an interesting question. Of course, this is not the first time such a suit has beenfiled. What is most inconceivable about the matter isthe particular religious organization from which thislawsuit originates – the Seventh-day Adventist Church. What, you may ask, is so unbelievableabout the Seventh-day Adventist Churchinitiating a lawsuit, and that, in leaguewith a “fictional person?” I will take therest of the space here to explain.

The Seventh-day Adventist Church (according to theirown encyclopedia) is “aconservative Christianbody, worldwide in ex-tent, evangelical in be-liefs, and professing nocreed but the Bible.”They further state “thechurch is administeredby a representative or-ganization ranging fromthe local churches, through the conferences(or mission, or sections, the terminology variesin different countries)and unions, to the Gen-eral Conference, with its11 divisions in various parts of the world.” (volume11, page 575) One would conclude that the GeneralConference speaks as the supreme representative andauthority of the international body of Seventh-day Ad-ventist Church members, and this is confirmed by theSDA Encyclopedia (volume 10, pages 583-585).It is also significant to explain what SDAs (as they areoften called) refer to as “the Spirit of Prophecy.” TheSDA Encyclopedia says, “Seventh-day Adventists ap-ply the term spirit of prophecy to the operation of thegift of prophecy, one of the “gifts” of the Spirit (see 1Corinthians 12:4, 7-11, 28; Ephesians 4:11-13), andthus to the literary productions of Ellen G. White, acofounder of the church and one whom Seventh-dayAdventists regard as having been the recipient of thegift of prophecy in the Bible sense of a duly accreditedand authoritative spokesperson for God.” (volume 11,page 691)

The Seventh-day Adventist Church has, from her inception, ma- jored in being a “commandment-keeping” movement. That is tosay, the members profess to keep all of the Ten Commandments, not just nine of them. Of course, they point out that the Sabbathcommandment is the one controverted throughout Christendom.I want to begin my explanation now by detailing how the Plain-tiffs in our controversy are breaking every sacred tenet of thecommandments of God through filing a civil lawsuit to protecttheir “trade name” via the “sword of Caesar” – “It is time forThee, [YAHWEH], to work: for they have made void Thylaw.” (Psalm 119:126; brackets and name for “LORD” sup-plied)Notice what the Bible says: “Love worketh no ill to hisneighbour: therefore love is the fulfilling of the law.” (Romans13:10) And further, “Though I speak with the tongues of menand of angels, and have not [love], I am become as soundingbrass, or a tinkling cymbal. And though I have the gift of proph-ecy, and understand all mysteries, and all knowledge; andthough I have all faith, so that I could remove mountains, andhave not [love], I am nothing. And though I bestow all mygoods to feed the poor, and though I give my body to be burned, and have not [love], it profiteth me nothing.” (1 Corinthians13:1-3) Obviously, love, that is, unconditional love (that qualityof love that reflects the character of God Himself) is the primefactor in considering who is truly a “commandment-keeper.”The General Conference has proven her loss of compassion inviolating the second great commandment, “Thou shalt love thyneighbour as thyself.” (Matthew 22:39) The Savior gave furthercounsel with respect to treatment of others: “Ye have heard thatit hath been said, Thou shalt love thy neighbour, and hate thineenemy. But I say unto you, Love your enemies, bless them thatcurse you, do good to them that hate you, and pray for themwhich despitefully use you, and persecute you; That ye may bethe children of your Father which is in heaven: for he maketh hissun to rise on the evil and on the good, and sendeth rain on the just and on the unjust. For if ye love them which love you, whatreward have ye? do not even the publicans the same? And if yesalute your brethren only, what do ye more than others? do noteven the publicans so? Be ye therefore perfect, even as yourFather which is in heaven is perfect.” (Matthew 5:43-48) Thislack of love is not unique to this generation, as the Bible indi-cates, “Have we not all one father? hath not one God created us?why do we deal treacherously every man against his brother, byprofaning the covenant of our fathers?” (Malachi 2:10) Speak-ing of professors of a religion devoid of love, Ellen Whitewrites, “Professing to be the followers of God, they had turnedfrom the holy commandment, and were as salt that had lost itssavor.” (The Signs of the Times, March 14, 1895)Now, having dealt with the core motivation of thelaw of God, let us break down each of the firstfour commandments and see how my adversarieshave erred.
The First Commandment:
“Thou shalthave no other gods before me.” (Exodus 20:3) If at any time, aperson or church places anything, whether it be opinion, person, doctrine, policy or property, before the performance of lovetoward their Creator, this commandment is being violated. Myallegation is that the General Conference has positioned her“good name,” that is, her corporate image in estimation of as-sets, above the God of Heaven. This amounts to the “love of money” more than the love of her Maker. See what the Scrip-tures say: “No man can serve two masters: for either he willhate the one, and love the other; or else he will hold to the one,and despise the other. Ye cannot serve God and mam-mon.” (Matthew 6:24) And, “they that will be rich fall intotemptation and a snare, and into many foolish and hurtful lusts, which drown men in destruction and perdition. For the love of money is the root of all evil: which while some coveted after, they have erred from the faith, and pierced themselves throughwith many sorrows. But thou, O man of God, flee these things;and follow after righteousness, godliness, faith, love, patience, meekness.” (1 Timothy 6:9-11)
The Second Commandment:
“Thou shalt not makeunto thee any graven image, or any likeness of any thing that isin heaven above, or that is in the earth beneath, or that is in thewater under the earth: Thou shalt not bow down thyself tothem, nor serve them: for I the LORD thy God am a jealousGod, visiting the iniquity of the fathers upon the children untothe third and fourth generation of them that hate me; Andshowing mercy unto thousands of them that love me, and keepmy commandments.” (Exodus 20:4-6) The General Confer-ence Corporation is a “fictional person” or image of a naturalperson. Society has structured the legal system in such a wayas to make owning property by a church nearly impossiblewithout creating a holding company or legal corporation. TheSeventh-day Adventist Church has opted to form an image of herself for said purpose. If the Church had stopped here, therewould have been no transgression. However, the command-ment says not to “bow down thyself . . . nor serve” “any like-ness” of what God has already created. In opting to employ theGeneral Conference Corporation to initiate lawsuits, theChurch now bows herself down in a mode of worship, prayingfor this “fictitious person” to somehow defend her and protecther from her adversaries. Rather than seeking deliverance inEl Shaddai, the Almighty God and supreme provider, she re-sorts to “man-made fables” in place of divine power. Ellen G.White, cofounder of the Seventh-day Adventist Church wrote:“Some will be honest when it costs nothing; but when policywill pay best, honesty is forgotten. Honesty and policy will notwork together in the same mind. In time, either policy will beexpelled, and truth and honesty reign supreme, or, if policy ischerished, honesty will be forgotten. They are never in agree-ment; they have nothing in common. One is the prophet of Baal, the other is the true prophet of God.” (Lift Him Up, page287) The General Conference now worships policy and theways of the secular world more than God Almighty.
The Third Commandment:
“Thou shalt not take thename of the LORD thy God in vain; for the LORD will nothold him guiltless that taketh his name in vain.” (Exodus 20:7)This commandment could be developed in a long dissertation.Let me make this as brief and simple as possible.

Every name that God has and every name that He has ever givento His people originates in Him, and belongs to Him. It is unre-generate man’s desire and motivation to invent a better namethan God can give, such as was the case in Gen. 11:4, “. . . let usmake us a name, lest we be scattered abroad upon the face of thewhole earth.” Those apostates were not satisfied with the prom-ise of God demonstrated in the rainbow. The name He hadgiven them was not sufficient. And, it is the case with my cur-rent adversaries. They were not satisfied with the name the Al-mighty had blessed them with– Seventh-day Adventist. Theysought to “make a name” for themselves via the Federal andState trademark laws of the United States of America. In the actof submitting their name to the government policy for protec-tion, they unwittingly altered the meaning and value of their“God-given name.” Ellen White had clearly stated that“[Seventh-day Adventist] is the name the Lord has givenus.” (Letter 10, 1902; brackets supplied) Throughout the Bible, the principle is illustrated over and over that YAHWEH willfight the battles for His people. There is never the necessity of taking up “carnal weapons” in self-defense. Unfortunately, theGeneral Conference has employed the sword of Caesar asmethod of choice in protecting their “new name”– Seventh-dayAdventist®. Yet, some may ask, “What new name? It soundsand looks the same to me!” But, that is the essence of the de-ception– “spiritual things are spiritually discerned.” The origi-nal name was a “God-given and God-protected name;” the Fed-erally registered and protected name is different as to both itsfunction and character.
The Fourth Commandment:
“Remember the Sabbathday, to keep it holy. Six days shalt thou labour, and do all thywork: But the seventh day is the Sabbath of the LORD thy God:in it thou shalt not do any work, thou, nor thy son, nor thydaughter, thy manservant, nor thy maidservant, nor thy cattle, nor thy stranger that is within thy gates: For in six days theLORD made heaven and earth, the sea, and all that in them is,and rested the seventh day: wherefore the LORD blessed theSabbath day, and hallowed it.” (Exodus 20:8-11) The SDAChurch teaches that the Sabbath is the “seal of God.” This is thecommandment in which she majors. This is the divine mandatethat she prides herself in restoring to its rightful place in Chris-tendom. In the doing of this, she considers herself as “the re-pairer of the breach.” (Isaiah 58:12) The Apostle Paul warnedall believers, “Not that we are sufficient of ourselves to think any thing as of ourselves; but our sufficiency is of God; Whoalso hath made us able ministers of the new testament; not of theletter, but of the spirit: for the letter killeth, but the spirit givethlife.” (2 Corinthians 3:5, 6) This principle ought to have beensufficient to arrest the prideful channel taken by the GeneralConference organization. Since the letter of law does not fulfillthe law of love, all of the SDAs’ efforts to keep Saturday as the“seventh day” and convince others of the righteousness of suchobservance has been of no more value than the “filthy rags” of self-righteousness. (Isaiah 64:6) When the spirit of law is ne-glected, the legal form of righteousness denies “the power of God unto salvation,” (Romans 1:16) and as such, becomes adeath sentence of sorts for the adherent. All religions of thistype are “as dry as the hills of Gilboa.” (Ellen G. White, 1888Materials, p. 557)

Since the Sabbath commandment is so prominent among Sev-enth-day Adventists, it would be proper to develop the GeneralConference transgression in more detail. The author of He-brews has this to say, “For unto us was the gospel preached, aswell as unto them: but the word preached did not profit them, not being mixed with faith in them that heard it. For we whichhave believed do enter into rest, as he said, As I have sworn inmy wrath, if they shall enter into my rest: although the workswere finished from the foundation of the world. For he spakein a certain place of the seventh day on this wise, And God didrest the seventh day from all his works. And in this placeagain, If they shall enter into my rest. Seeing therefore it re-maineth that some must enter therein, and they to whom it wasfirst preached entered not in because of unbelief: Again, helimiteth a certain day, saying in David, To day, after so long atime; as it is said, To day if ye will hear his voice, harden notyour hearts. For if [Joshua] had given them rest, then would henot afterward have spoken of another day. There remaineththerefore a rest to the people of God. For he that is entered intohis rest, he also hath ceased from his own works, as God didfrom his. Let us labour therefore to enter into that rest, lest anyman fall after the same example of unbelief.” (Hebrews 4:2-11)This “Sabbath Rest Principle” to which the Apostle refers indi-cates the spirit of resting in Christ with full trust in the Provi-dence of God. The seventh day becomes to the Christian a“time mark” that reminds us of the intimate, restful relationshipwe experience in connection with the Savior. There is no sav-ing grace per se in keeping the seventh day Sabbath, but whenwe keep ourselves holy, and that is to say, healthy in spirit, weobserve the Sabbath as “a sign between [Elohim/God] and [Hisbelievers], that they might know that I am [YAHWEH] thatsanctify them.” (Ezekiel 20:12) The writer of Hebrews contin-ues, “Follow peace with all men, and holiness, without whichno man shall see [YAHWEH]:” (Hebrews 12:14) The Sabbath, then, is a representation in time that we are God’s children, living in the sanctified life of growth in Christian graces.[brackets supplied]The Bible is certainly a sufficient foundation on which to basemy conclusions, but I am compelled to add what I consider aninspired section from the 1895 General Conference Bulletin,“Now I want to state a little further upon the principle that noChristian, being a citizen of the kingdom of God, can of rightstart any procedure in connection with civil government. Afterit is started by the government itself, that is another ques-tion . . . I repeat therefore, that upon the principles which gov-ern kingdoms and governments, the very principle of the law inheaven, or law in earth, a Christian cannot start any procedurein connection with civil government. And of all Christians,SEVENTH-DAY ADVENTISTS cannot do it. The very keep-ing of the Sabbath forbids it.” (Alonzo T. Jones, Sermon 7,para. 28, 29; caps supplied)The loss of trust in and reliance upon the Creator has revealedthe true character of the General Conference. She has not en-tered into that rest described by the Apostle. She has overtlyviolated the principles of love pertaining to man’s relationshipwith his Creator, summarized in the first four commandmentsof the Decalogue. The Scripture in James 2:10 is applicable
