ORDINANCE NO.AN ORDINANCE AMMENDING SECTIONS 19.31.010, 19.31.020, 19.31.030,19.31.040, 19.31.050, 19.31.060, 19.31.070, 19.31.080, 19.31.090, 19.31.100, 19.31.110,19.31.120, 19.31.130, 19.31.140, 19.31.150, 19.31.160, 19.31.170, 19.31.180, 19.31.190,19.31.200, 19.31.210, 19.31.220, 19.31.230, 19.31.240, 19.31.250, 19.31.260, 19.31.270,19.31.280, 19.31.290, 19.31.300, 19.31.310, 19.31.320, 19.31.330, 19.31.340, 19.31.350,19.31.360, 19.31.370, 19.31.380, 19.31.390, 19.31.400, 19.31.410, 19.31.420, 19.31.430OF THE OAK HARBOR MUNICIPAL CODE TO ESTABLISH NEW REVIEWCRITERIA AND DESIGN STANDARDS FOR PLANNED RESIDENTIALDEVELOPMENTS WHICH ARE INTENDED TO MITIGATE IMPACTS FROMREDUCED LOT SIZES AND / OR SETBACKS, REQUIRE THAT OPEN SPACE BEVISIBLE, USEABLE AND ACCESSIBLE AND SIMPLIFY THE DEVELOPMENTREVIEW PROCESS.WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land usegoal 2 directs it to “retain the character and visual identity of the Oak Harbor area” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use policy 2 (a) directs it to “encourage planned residential development (PRDs) with performance based standards” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use policy 2 (b) directs it to “consider view corridors when planning for development” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land usegoal 4 directs it to “preserve community character through quality design” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land usegoal 5 (a) directs it to “encourage private and public preservation of undeveloped openspace” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use policy 5 (b) directs it to “require adequate buffers between proposed new developmentand existing land uses” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land usegoal 11 directs it to “encourage a sense of community through development of a spectrumof housing types that, collectively, would help to create diverse neighborhoods” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use policy 11 (d) directs it to “create a mix of housing types within the price range of youngfamilies and seniors” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use

 policy 14 (c) directs it to “allow neighborhood scale services that are compatible withresidential areas. Develop standards to ensure that such services are compatible inlocation, scale, design and intensity with the prevailing neighborhood character” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land usegoal 19 directs it to “create and maintain a balanced community that mixes residentialand non-residential uses in a way that promotes environmental quality and communityaesthetics” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use policy 19 (c) directs it to “encourage the retention of open space in new development,especially when such action will protect or enhance a wetland or wildlife habitat area”and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, land use policy 19 (e) directs it to “provide adequate parks, playgrounds and other open spaces for residents and visitors to create a pleasant environment for the community” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, urbandesign goal 4 directs it to “develop a public realm that is safe, aesthetically pleasing andinteresting while promoting street life, opportunities for community interactions, andcommercial and social activities” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan,transportation policy 5 (c) says that “the City should design intersections which provideadequate safety for pedestrians and bicyclists” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, urbandesign policy 4 (a) says that “ the City should develop policies to strengthen the sense of  place and unique qualities of its various districts and neighborhoods” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, urbandesign goal 5 directs it to “protect view sheds and view corridors” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, openspace goal 1 directs it to “preserve a system of open space lands in Oak Harbor and itsenvirons that provides a variety of public benefits” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, openspace policy 1 (d) directs it to “promote the conservation of open spaces that are in both public and private ownership” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, openspace policy 1 (i) directs it to “require buffers between incompatible land uses; encouragethe use of open space for this purpose” and,

WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, housing policy 1 (g) directs it to “ allow provisions in development regulations for inclusionaryaffordable housing and density bonus performance standards” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, utilities policy 5 (b) directs it to “continue to support energy efficiency by encouraging lowimpact sustainable development through building practices, landscaping and site designs,which promote natural resource conservation” and,WHEREAS, the City of Oak Harbor acknowledges that its Comprehensive Plan, utilities policy 5 (d) directs it to “encourage use of storm drainage solutions, which use natural processes to make existing infrastructure more efficient while protecting wetlands anddrainage functions.” NOW, THEREFORETHE CITY COUNCIL OF THE CITY OF OAK HARBOR do ordain as follows:
Section One
. Oak Harbor Municipal Code Chapter 19.31 entitled “Planned ResidentialDevelopments” last amended by Ordinances 1221 in 2000 is hereby repealed in itsentirety.
Section Two.
Chapter 19.31 of the Oak Harbor Municipal Code is hereby re-adopted tocontain the following chapters:
