We are pleased that JC Penney desires to remain at Westdale Mall and appreciate the time and effort it took for you to visit with us in Cedar Rapids. We offer the following thoughts to move the discussion along. First, we understand that you submitted to Frew Development Group a proposal for remaining at Westdale in your current building, including specific comments on the city-approved Master Plan for the site. While we do not know the details of your proposal, John Frew has confirmed to us that it is a step in the right direction and that he has provided a comprehensive response to you. Second, it is our understanding that you have extended conditional approval to the developer to demolish the former Montgomery Wards building. That is a positive step forward, but demolition and site work both need to commence immediately. We hereby resubmit our request that site work be allowed to proceed in addition to demolition of the Wards building. Lastly, and perhaps most important, we need to clarify our position regarding the citys use of its power of eminent domain. We have the highest expectation that you and Frew Development Group will find common ground through negotiations that is fair and balanced to both sides and that preserves the citys vision for a redeveloped Westdale Mall. However, the citys exercise of its power of eminent domain is a decision for the entire council to make and is therefore not something that we can guarantee will or wont happen. We see condemnation as a last resort and it is our most sincere hope that this project will move forward without government intervention.
