Rep. Adam Schiff (D-CA), a senior Member of the Intelligence Committee, introduced legislation, the Ensuring Adversarial Process in the FISA Court Act. This legislation would allow non-governmental attorneys to participate before the Foreign Intelligence Surveillance Court (FISC) as “Public Interest Advocates” in significant constitutional cases and reviews of major surveillance programs.

This Act may be cited as the ‘‘Ensuring Adversarial

N GENERAL
.—Section 1061(d) of the Intel-

ligence Reform and Terrorism Prevention Act of

2004 (42 U.S.C. 2000ee(d)) is amended by adding 
8
at the end the following new paragraph:

‘‘(5) A 
PPOINTMENT OF PUBLIC INTEREST AD

‘‘(A) A 
PPOINTMENT
.—The Board shall ap-
12
point attorneys to serve as public interest advo-
13
cates in proceedings before the Foreign Intel-
14
ligence Surveillance Court, a judge of the peti-
15
tion review pool, the Foreign Intelligence Sur-
16
 veillance Court of Review, and the Supreme
17
Court under the Foreign Intelligence Surveil-
18
lance Act of 1978 (50 U.S.C. 1801 et seq.).

‘‘(B) R
EQUIREMENTS
.—In making ap-
20
pointments under subparagraph (A), the Board
21
shall—
22
‘‘(i) consult with the Attorney Gen-
23
eral;
24
‘‘(ii) appoint attorneys with expertise
25
and experience in cases involving privacy 
26

3and civil liberties who are not employees of

the Federal Government;

‘‘(iii) consider candidates with dem-
3
onstrated expertise in and commitment to
4
constitutional and legal protections for pri-
5
 vacy and civil liberties;
6
‘‘(iv) consider the availability of can-
7
didates to appear before the Foreign Intel-
8
ligence Surveillance Court, a judge of the
9
petition review pool, the Foreign Intel-
10
ligence Surveillance Court of Review, or
11
the Supreme Court in urgent matters;
12
‘‘(v) consider the ability of candidates
13
to obtain and maintain an appropriate se-
14
curity clearance to participate fully in mat-
15
ters before the Foreign Intelligence Sur-
16
 veillance Court, a judge of the petition re-
17
 view pool, the Foreign Intelligence Surveil-
18
lance Court of Review, and the Supreme
19
Court under the Foreign Intelligence Sur-
20
 veillance Act of 1978 (50 U.S.C. 1801 et
21
seq.); and
22
‘‘(vi) provide notice to the Attorney

General and the presiding judge of the
