Article IRecognition
A. The Board acknowledges and recognizes the Orange Education SupportProfessionals Association (OESPA, FEA, and its national affiliates), hereinafterreferred to as the Union, as the exclusive bargaining representative for classifiedemployees, whether on active duty or Board approved leave of absence, and agreesto negotiate with the Union's designated representative pursuant to the provisions ofPart II, Chapter 447, Florida Statutes.B. The Union acknowledges and recognizes the School Board of Orange County,Florida, hereinafter referred to as the Board, as the duly elected representative ofthe people of Orange County, Florida, and agrees to negotiate with the Board's ChiefExecutive Officer or his representative pursuant to the provisions of Part II, Chapter447, Florida Statutes.C. The Bargaining unit shall be defined as set forth by the Public Employees RelationsCommission (PERC) (Case Number RC 92-008, Certificate Number 700, asamended, CERTIFICATION OF REPRESENTATION FOLLOWING ELECTION ANDORDER TO NEGOTIATE issued by the Florida Public Employees RelationsCommission on the thirtieth day of July, 1992).1. INCLUDED: All full-time and regular part-time classified personnel employed bythe Board as defined by PERC.2. EXCLUDED: All other positions of the Orange County Public Schools areexcluded.3. This definition may be subject to PERC clarification of job titles and new job titleswithin the bargaining unit. The parties agree to review periodically positions inthe unit and mutually petition PERC for unit clarification. It is recognized theparties may petition, either mutually or independently, PERC for unit clarificationat any time subject to the laws of the State of Florida.D. The provisions set forth herein for wages, hours, and terms and conditions ofemployment shall be applied consistently for all employees covered by this Contract.Unless otherwise specified, terms used in this Contract shall be as defined in theGlossary of Terms which is incorporated into and hereby made a part of thisContract.E. Any official notice between the Union and the Board required under this Contractshall be made by U.S. mail, by facsimile, or by hand delivery to a designatedrepresentative of the party.
