:
The Department of Labor, aspart of its continuing effort to reducepaperwork and respondent burden,conducts a pre-clearance consultationprogram to provide the general publicand Federal agencies with anopportunity to comment on proposedand/or continuing collections of information in accordance with thePaperwork Reduction Act of 1995(PRA95) [44 U.S.C. 3506(c)(2)(A)]. Thisprogram helps to ensure that requesteddata can be provided in the desiredformat, reporting burden (time andfinancial resources) is minimized,collection instruments are clearlyunderstood, and the impact of collectionrequirements on respondents can beproperly assessed. I. Background
The Vietnam Era Veterans
’
Readjustment Assistance Act of 1974(
‘‘
VEVRAA
’’
), 38 U.S.C. 4212(d),requires Federal contractors andsubcontractors subject to the Act
’
saffirmative action provisions in 38U.S.C. 4212(a) to track and reportannually to the Secretary of Labor thenumber of employees in theirworkforces, by job category and hiringlocation, who belong to the specifiedcategories of covered veterans. VETShas issued regulations set forth in 41CFR part 61
–
250 that currently requirecontractors to use the Federal ContractorVeterans
’
Employment Report VETS

) form forreporting information on the number of covered veterans in their workforces.The VETS
–
100 Report is currentlyapproved under OMB No. 1293
–
0005.The Jobs for Veterans Act (JVA) (Pub.L. 107
–
288), which was enacted in2002, amended VEVRAA by making twochanges to the reporting requirementsapplicable to contracts entered into onor after December 1, 2003. The JVAamendments: (1) Increased from $25,000to $100,000, the dollar amount of thecontract that subjects a Federalcontractor to the requirement to reporton veterans
’
employment; and (2)changed the categories of coveredveterans under VEVRAA, and thus thecategories of veterans that contractorsare required to track and report onannually.The JVA amendments to the reportingrequirements under VEVRAA applyonly to contracts entered into on or afterDecember 1, 2003. Some contractorshave Government contracts that wereentered into before December 1, 2003,and are still subject to the reportingrequirements in 41 CFR part 61
–
250.Therefore, VETS has determined that itwill be necessary to maintain two setsof regulations to implement thereporting requirements under VEVRAA,and use two different forms forproviding the required information onthe employment of covered veterans.On August 8, 2006, VETS publisheda Notice of Proposed Rulemaking(NPRM), (71 FR 44945), to implementthe changes made by JVA to thereporting requirements under VEVRAA.The NPRM proposed to adopt a new setof regulations that would be codified ina new 41 CFR part 61
