January 9, 2009This case is one for copyright infringement under 17 U.S.C.§ 106. The Plaintiffs are some of the nation's largest recordcompanies; they seek subpoenas to uncover the identities ofindividual computer users -- college students -- who are usingpeer-to-peer software to share copies of the plaintiffs'copyrighted musical recordings. One Defendant in the caseoriginally titled Arista Records LLC v. Doe 1, No. 07CV10834,moved to quash the subpoena. This Court granted the Motion, seeOrder on Motions to Quash (document # 167), 542 F.Supp.2d 153 (D.Mass. 2008), ordering the subpoena to be quashed and re-served asmodified. The facts and law in the case are laid out in detailin that Order, and familiarity with it is presumed.

The Court now has before it a number of motions challengingaffidavits and subpoenas derived from evidence gathered byMediaSentry, Inc. ("MediaSentry"). MediaSentry is anorganization that searches for possible copyright infringement onpeer-to-peer networks on the Plaintiffs' behalf. Doe 1, whosename is unknown, seeks to strike the Declaration of CarlosLinares (docket no. 07-cv-10834, document # 5), in part based onevidence gathered by MediaSentry, Inc. Mot. to Strike Decl. ofCarlos Linares (document # 170). This motion concerns thesubstantive evidence provided by the Plaintiffs and relied uponby the Court in its previous Order. The Plaintiffs oppose theDefendant's motion, and further seek to quash a subpoenaaddressed to the Massachusetts State Police Keeper of Records.Mot. to Quash (document # 185).In addition, a second unnamed defendant, Doe 16, has nowmoved to quash a subpoena issued to Boston University ("theUniversity") seeking individual computer user information thatwould identify the Defendant. Am. Mot. to Quash (document #218). Doe 16 challenges the subpoena primarily because it isbased on evidence allegedly obtained by MediaSentry illegally orimproperly. The movant also argues that compliance would imposean undue burden on the University, and that any infringement wasunintentional and thus is not actionable.
