"Commissioner" means thecommissioner of administration or the commissioner's dulyauthorized representatives.Subp. 13.
"Constructionalteration" means the replacement, addition, modification, orremoval of any equipment or installation which may affect theconstruction, plumbing, heating, cooling, or fuel-burningsystem, or electrical system or the functioning of any of thesein manufactured homes subject to the code.Subp. 14.
Construction compliance certificate.
"Construction compliance certificate" means the certificateprovided by the manufacturer or dealer to both the commissionerand the owner which warrants that the manufactured home complieswith the code.Subp. 15.
"Dealer" means any person who engagesin the business, either exclusively or in addition to any otheroccupation, of selling or brokering manufactured homes, new orused, or who offers to sell, solicit, broker, or advertise thesale of manufactured homes, new or used.Subp. 16.
"Defect" means a failure to comply withan applicable federal mobile home construction and safetystandard in Code of Federal Regulations, title 24, part 3280,that renders the manufactured home or any part or component ofit not fit for the ordinary use for which it was intended, butthat does not result in an unreasonable risk of injury or deathto occupants of the manufactured home.Subp. 17.
Design approval inspection agency.
"Designapproval inspection agency" means a state or privateorganization that has been accepted by the secretary.Subp. 18.
"Diagonal tie" means a tieintended primarily to resist horizontal or shear forces andwhich may secondarily resist vertical, uplift, and overturningforces.Subp. 19.
"Distributor" means any personengaged in the sale and distribution of manufactured homes forresale.Subp. 20.
"Evaluation agency" means anorganization approved by the secretary which is qualified byreason of facilities, personnel, experience, and demonstratedreliability to investigate and evaluate manufactured homes.Subp. 21.
Failure to conform.
"Failure to conform"includes noncompliance, having a defect or serious defect, andhaving an imminent safety hazard related to failure to complywith an applicable federal mobile home construction and safetystandard in Code of Federal Regulations, title 42, part 3280."Failure to conform" is used as a substitute for all of thoseterms.Subp. 22.
"Footing" means that portion of the
