DEFENDANT JANET M. RAINEY'S MEMORANDUMIN SUPPORT OF MOTION FOR SUMMARY JUDGMENT
COMES NOW, Janet M. Rainey, in her official capacity, by counsel, in accordance withthe Court's scheduling order of August 30, 2013 (Doc. 17), and in support of her Motion for Summary Judgment (Doc. 38) states as follows.
I. STATEMENT OF THE CASE AND PROCEDURAL POSTURE
The case is before the Court, and Plaintiffs and Rainey have joined issue, on Plaintiffs'First Amended Complaint (Doc. 18) and the Answer of Janet M. Rainey (Doc. 21).
II. STATEMENT OF UNDISPUTED LEGISLATIVE FACTS
1.
 
The Act of Uniformity of 1559, 1 Eliz., c.2, required the use of the Book of Common Prayer of 1559 in the Church of England, the church established by law. An Act for the Uniformitie of Common Praier, and Service in the Church, and the Admistracion of theSacramentes, http://justus.anglican.org.resources/bcp/1559/front_matter_1559.htm. Both therubrics and the liturgy of marriage required a man and a woman.

The act of May 1730, forbidding marriage "within the levitical degrees prohibited by the laws of England" prohibited certain men from marrying certain women and vice versa. 4W

When the requirements for marriage banns or license were reenacted in October 1748, there was a requirement added to the effect that it can be certified that "the feme so to be joined hath been an inhabitant of the said parish, one month next before the date of suchcertificate." The requirement that "every licence for marriage shall be issued by the clerk of thecourt of that county wherein the feme usually resides" was continued. 6

In October 1780, in the fifth year of the Commonwealth, the General Assemblyenacted "An act declaring what shall be a lawful marriage." It began: "FOR encouragingmarriages and for removing doubts concerning the validity of marriages celebrated by ministers,other than the Church of England,

, that it shall and may be lawful for any minister of any society or congregation of christians, and for the society of christians called quakers and menonists, to celebrate the rights [sic] of matrimony, and to jointogether as man and wife, those who may apply to them agreeable to the rules and usage of therespective societies to which the parties to be married respectively belong, and such marriage aswell as those heretofore celebrated by dissenting ministers, shall be, and are hereby declaredgood and valid in law." 10 W
