RESOLUTIONNO. 09.38A Resolutionf theAlbanyCityCouncilRequestingheFederalGovernmenttoUpdateStudieson PotentialHealth Effectsof RadioFrequencyWirelessEmissionsn LightofProliferationof WirelessUse.WITEREAS,state and localgovernments,ncludingtheCity ofAlbany,arepreemptedby federalaw fromconsideringhealthconcernsnthe regulationandplacementf wirelessacilities,soong assuch acilitiesotherwiseomplywithapplicableederalaw;andWHEREAS'the FederalCommunicationsommissionFCC)hasurisdictionover non-federalwireless facilities,authorizingand licensingall non-federaldevices, transmittersandfacilitiesthatgenerateRadioFrequency (RF)radiation;ndWHEREAS,theFCC hashistoricallyeliedonfederalagencieswithhealtharrd safetyexpertise,suchas theFood andDrugAdministration (FDA),theEnvironmentalProtectionAgency(EPA)theNationalInstituteforOccupationalSafety andHealthOTIOSH)andthe OccupationalSafetyandHealthAdministration OSHA)who eachhave assignedolesin monitoringand nvestigatingssueselatedo RFexposure;ndWHEREAS'the GovernmentAccountingoffice(GAo)in2001preparedareportof its investigationntosafetyconcernselatedtomobilephonesandconcludedthatfurtherresearchintowirelesstechnologyis needed,recommendinghe FDAtakehe eadn monitoringresearchesults;andWHEREAS'theFCCin 2003lastupdatedguidelinesorhumanexposureoRFelectromagneticfieldsfromwirelessfacilities,basedprimarilyonrecommendationsfother federalagenciesafterreviewsofpriorscientificliteratureelated oRF biologicaleffects,rimarilyromthe 1990s;ndWHEREAS,a surveyreleasednMay2A09 fromtheCentersor DiseaseControland Preventionhows hatfor thefirsttime thenumberof householdsintheU.S. whoonly havecellphonesexceedshe numberofhouseholdshoonly haveandlines;
