It would have given control of medical cannabis over to the Washington State Liquor Control Board. I-502 was run on the promise to voters that it would not interfere with our Medical Cannabis laws.

Sec. 1.
RCW69.51A.010 and 2010 c 284 s 2 are each amended to read10as follows:11The definitions in this section apply throughout this chapter12unless the context clearly requires otherwise.13(1) "Cannabis" means all parts of the plant
whether14growing or not; the seeds thereof; the resin extracted fromany part o15the plant; and every compound, manufacture, salt, derivative, mixture,16or preparation of the plant, its seeds, or resin. For the purposes o17this chapter, "cannabis" does not include the mature stalks of the18plant, fiber produced fromthe stalks, oil or cake made fromthe seeds19of the plant, any other compound, manufacture, salt, derivative,p. 1SB 5887
1mixture, or preparation of the mature stalks, except the resin2extracted therefrom, fiber, oil, or cake, or the sterilized seed of the3plant which is incapable of germination. "Cannabis" includes cannabis4products and useable cannabis.5(2) "Cannabis products" means products that contain cannabis or6cannabis extracts, have a measurable THC concentration greater than one7percent, and are intended for human consumption or application,8including, but not limited to, edible products, tinctures, and lotions.9"Cannabis products," does not include useable cannabis. "Cannabis10products," as a measurement of THC concentration, only applies to the11provisions of this chapter and is not considered applicable to any12criminal laws related to marijuana or cannabis.13(3) "Collective garden" means qualifying patients sharing14responsibility for acquiring and supplying the resources required to15produce, process, and deliver cannabis for medical use such as, for16example, a location for a collective garden; equipment, supplies, and17labor necessary to plant, grow, and harvest cannabis; cannabis plants,18seeds, and cuttings; and equipment, supplies, and labor necessary for19proper construction, plumbing, wiring, and ventilation of a garden o20cannabis plants.21(4) "Correctional facility" has the same meaning as provided in RCW2272.09.015.23(5) "Corrections agency or department" means any agency or24department in the state of Washington, including local governments or25jails, that is vested with the responsibility to manage those26individuals who are being supervised in the community for a criminal27conviction and has established a written policy for determining when28the medical use of cannabis, including possession, manufacture, or29delivery of, or for possession with intent to manufacture or deliver,30is inconsistent with and contrary to the person's supervision.31(6) "Deliver" means a medical cannabis dispensary that makes32deliveries of medical cannabis and other medical cannabis products to33qualifying patients by way of automobile, bus, bicycle, or any other34conveyance.35(7)(a) "Designated provider" means a person who:36(((a))) (i) Is eighteen years of age or older;37(((b))) (ii) Has been designated in ((writing)) a written documentSB 5887p. 2
1signed and dated by a qualifying patient to serve as a designated2provider under this chapter; and3(((c))) (iii) Is ((prohibited from
consuming marijuana obtained for4the personal, medical use of the patient for whom
the individual is5acting as designated provider; and6(d) Is the
designated provider to
only one patient at any one
time.7(2))) in compliance with the terms and conditions set forth in RCW869.51A.040.9(b) A qualifying patient may be the designated provider for another10qualifying patient and be in possession of both patients' cannabis at11the same time.12(8) "Dispense" means the selection, measuring, packaging, labeling,13delivery, or retail sale of cannabis by a licensed dispenser to a14qualifying patient or designated provider.15(9) "Health care professional," for purposes of this chapter only,16means a physician licensed under chapter 18.71 RCW, a physician17assistant licensed under chapter 18.71A RCW, an osteopathic physician18licensed under chapter 18.57 RCW, an osteopathic physicians' assistant19licensed under chapter 18.57A RCW, a naturopath licensed under chapter2018.36A RCW, or an advanced registered nurse practitioner licensed under21chapter 18.79 RCW.22(((3))) (10) "Health care services" means services provided by a23health care professional under the standard of care for his or her24profession and does not include the sale of supplements, drugs,25remedies, or other retail sales for the purposes of this chapter.26(11) "Label" means all labels and other written, printed, or27graphic matter upon any cannabis intended for medical use or28accompanying such cannabis.29(12) "Medical cannabis dispensary" means a facility licensed by the30liquor control board and that dispenses cannabis for medical use to31qualifying patients and designated providers.32(13) "Medical cannabis processor" means a person or entity licensed33by the liquor control board that operates in a licensed commercial34kitchen that processes cannabis leaves and flowers into oils, foods,35extracts, resins, lotions, drinks, and other forms of infused cannabis36products. The termis not intended to include the trimming and sorting37of flowers, stems, and leaves by a medical cannabis producer into38useable cannabis.p. 3SB 5887
