representative ofthe LA Superior Courtnor Judge Yaffe's did so either.
Further,theMagistrateJudge'sReportstatedatpage10,lines6-10:
<&Atthe sentencing hearing Petitioner indicated thathe would go on
refusing to answer Commissioner Gross's questions untilhis habeas
corpusactions(includingthepresentcase)weretçentirelyfinished,''but
wouldanswerquestionsifhelostinthehabeasproceedings.(Sentencing
transcriptat9-111Todate,Petitionerhasnotcompliedwiththecontempt
order and remains in custody atLos Angeles County Jail for civil
contempf'.
Since (jailing'' Fine was not going to ilcoerce''him to answer
CommissionerGross'questionsasJudgeYaffeknew thatFinewouldanswer
such ifhelostthehabeascorpusproceedings,theremusthavebeen another
reasontoincarcerateFine.
FinesubmitsthatthereasonisthatFinewasthefirstlawyertochallenge
the now illegaland unconstitutionalpayments from LA County to the LA
SuperiorCourtjudges.TheLA SuperiorCourthasbeenretaliatingag>instFine
forsuchcontinuouschallenges.Throughitsjudicialofficersithasgonetothe

1 CaliforniaStateBarand soughthisdisbarmentforhisbringing substantively


correctFederalcivilrightscaseschallenging thepaymentsand disqualifying
judicialofficerswhoreceivethepayments.TheStateBardisbarredFine.A
PetitionforWritofCertiorariispresentlybeforetheUSSupremeCourtincase
no.08-1573. The questionspresented relate to whetherCalifornia Supreme
Courtjusticeswhoreceivedunconstitutionalpaymentsfrom countieswhile
superiorcourtjudgesandhavereceivedretroactiveimmunityfrom criminal
prosecution,civilliabilityanddisciplinaryactionshouldrecusethemselvesfrom
presidingoverthesameissueinthedisbarmentcaseandtheFirstAmendment
righttofiletruthfulpleadings,amongotherthings.
The contempt proceeding and the incarceration of Fine is the latest
retaliationasFineshowed in thecontemptproceedingthat,in theunderlying
case,the vote ofthe LA County Board of Supervisors was illegaldue to
contributionsbythedevelopertotwoBoardmemberswithintwelvemonthsof
thevote.FinethenshowedtheillegalpaymentstoJudgeYaffefrom theCounty
andJudgeYaffe'smakingillegalordersinfavorofLA County.
Thedocumentssubmittedforjudicialnoticehereinshowthattherulingsof
theLA SuperiorCourtjudgesin favorofLA Cotmty asan effectofthe
paymentsfrom LA Countyisrampantandhasdenied10millionresidentsofLA
Countymeaningfulaccesstothecourtsandafairjudicialsystem.
lnanormalsituation,ajudgewouldhavestayedtheexecutionofsentence
inthiscasetoallow thewritproceduretoproceed. JudgeYaffeknew thata
PetitionforWritofHabeasCorpuswasbeforetheCaliforniaSupremeCourton
March4,2009,andthatalsoachallengeastotheirabilitytohearthePetition
wasbeforethem.Healsoknew thatFinewouldgointotheFederalsystem.The
solereasontoincarcerateFinewasretaliation.JudgeYaffehadbeenççexposed''
favoringLA CountyasaneffectoftheillegalandunconstitutionalLA County
paymentstohim.HeretaliatedandincarceratedFine.
