INSTRUCTION TO TENDERERS

1. The term superintending Officer (S.O.) wherever used hereinafter and in all quotation documents shall mean Perunding Jati Sdn. Bhd, No. 15-3A, Jalan PJU 5/13, Dataran Sunway, Kota Damansara, 47810 Petaling Jaya, Selangor Darul Ehsan. The Tenderer is required to pay RM100.00 for the documentation fees made payable to Perunding Jati Sdn Bhd, which will not be refundable. Tenderers shall at their own expenses, visit and examine the site, and obtain for themselves all information that may be necessary to complete a proper Quotation, and shall examine carefully the quotation Documents and Drawing in order to ascertain and satisfy themselves as to extent risks and obligations required in this quotation. Any expenses incurred by the Tenderers in the preparation of this tender will be borne by the Tenderers. The successful Tenderer must obtain a Public Liability Insurance not less than RM250,000.00 (Ringgit Malaysia: Two Hundred and Fifty Thousand Only). The Liquidation Ascertained Damage for failing to complete within the stipulated time for no valid reasons will be RM200.00 (Ringgit Malaysia: Two Hundred Only) per day. Each tender must be accompanied by a Bank Draft or Bankers Guarantee for the amount of RM1,000.00 (Ringgit Malaysia: One Thousand Only) made out to Messrs KSB Hartanah Sdn Bhd. The earnest money will be forfeited in the event of the Contractor failing to stand by his tender but would otherwise be fully refunded after signing of the contract with the successful tenderer. Quotation shall remain valid for a period of 90 days. The term CLIENT wherever found in this document shall mean Messrs KSB Hartanah Sdn Bhd. Non-compliance with the above conditions in any respect shall render the tender liable to rejection. Tenderers must assure that works carried out are supervised by a Professional Engineer and the report submitted must be dully signed and certified correct by the Professional Engineer. The Professional Engineer must comply with the requirements of S8/2. The tenderer shall note that in the event his tender is accepted, the mobilization period shall be seven (7) days from the date of award.

The Specification and Bills of Quantities are to be read in conjunction with all other documents form part of the contract. No authorised alterations or erasures to the text of the Tender Document will be permitted. Any tender containing such alterations or erasures may not be considered. The tenderer shall be required to check the numbers of the pages of the Contract Bills against the page numbers given in the contents and should he find any missing, in duplicate or indistinct he must inform the S.O. in writing before the date for submission of tenders. Should the tenderer for any reason whatsoever be in doubt about the precise meaning of any item or figure he must inform the S.O. in writing before the date for submission of tenders. No liability will be admitted nor claim allowed in respect of errors in the Contractors tender due to mistake in the Contract Bills, which should have been rectified in the manner described. If any item contained in the contract Bills is not priced it shall be deemed that either: (i) (ii) the cost has been included elsewhere or no remuneration is required in respect of that item

The Client shall not be bound to accept the lowest or any tender, and in no case will any expenses incurred by tenderers in the preparation of the tender be allowed. The quantities shown in the bill of quantity is indicative only. The decimal amount to be paid upon completion of works shall be determined by remeasurement of the completed works, which are actually executed.
