ABSTRACT

The title Death Penalty: An analysis (Historical and Modern perspective) itself exhibits The purpose of this Article, that is to explain Death Penalty being a Capital Punishment is how far justified in the present scenario, as The Indian criminal jurisprudence is a blend of reformative and deterrent theories. While the punishments are to be imposed to deter the offenders, it is also inalienable part of Indian penal jurisprudence that the offenders should be given opportunity for reformation. I have also discussed principles of retribution Benthams Utilitarianism, Hobbs, and Kants views. Interesting issues are brought up like Miscarriage of Justice by Authorities, rarest of rare principle Delay in Execution and Human rights, politi cal dimension of Death Penalty.
