October 24, 2013 CORRECTED PRESS RELEASE Instead of July 3, 2013, the hearing was actually held on July 2, 2013 in the Northern District of Georgia in the case of AF Holdings, LLC v. Rajesh Patel, 2:12-cv-00262-WCO. After reviewing the transcript of the hearing, there was one additional correction. The previous press release attempted to summarize statements made before the lawsuit was filed, which were slightly inaccurate. An excerpt from the transcript of exactly what was said is below: THE COURT: Did you ask them if they had any evidence of its having been used in any way? MR. NAZAIRE: Yes, I did. And they said they did have evidence, Your Honor. THE COURT: They did have it. Well, did you ask what the evidence was? MR. NAZAIRE: Well, basically, a company they use I believe I wrote it down 6881 Forensics and basically yeah, basically they keep they keep all the information and when we need it they send it to us. THE COURT: Well, what did they send you? MR. NAZAIRE: No, they did not send me anything, Your Honor. THE COURT: You didnt ask them for anything? MR. NAZAIRE: Yes, I did, Your Honor, and they said they would send it. THE COURT: Was this before you filed the lawsuit? MR. NAZAIRE: Yes, it is, Your Honor. THE COURT: And you went ahead and filed the lawsuit even though youd requested something they hadnt sent to you? MR. NAZAIRE: Yes, Your Honor . . .
