org For Immediate Release Lawsuit filed by former employee against Willamette ESD is settled
SALEM Special Districts Association of Oregon, acting as the liability carrier through the PACE Trust, has reached a settlement of the claims against WESD filed by former employee Teresa Moore. The complaint, filed in Marion County Circuit Court in 2010, alleged violations of state statute and federal workplace protection provisions. The decision to settle was made by Special Districts Association of Oregon. The decision was based on their interest in resolving the matter and minimizing actual and potential cost. The cost to resolve the case, should the lawsuit be defended at trial, far exceeds the amount of the settlement. Additionally, moving forward to litigate the case contrary to the decision of the liability carrier would place the full financial burden of all costs on WESD. The case was settled for $150,000, with $86,355.75 going to Ms. Moore and the remaining $63,644.25 going to her attorney. The settlement is in no way an admission of wrongdoing or liability on the part of WESD. In reviewing the issues it is WESDs position that the allegations have been thoroughly investigated by both internal and external review and found to be without merit. WESD contracted with two different investigative firms to review some of the allegations. Further, the agency cooperated fully with the Oregon Department of Education, the Bureau of Labor and Industries and the Teacher Standards and Practices Commission in their review of the remaining allegations. In each case the claims were determined to be unfounded. Ken Hector, WESD Board Chair said, The Board understands Special Districts decision to settle this case. That decision is based on indisputable financial factors. Choosing to move forward to defend the case at trial would burden WESD with all attorney fees and costs, impacting our general fund. The ultimate outcome of resolution for this case is best for WESD, and the districts we serve. We continue to focus on our mission of providing quality educational services. WESD considers the matter brought by Ms. Moore resolved.
