f you are a Large Quantity Generator (LQG) of hazardous waste, you must comply with the fullset of federal hazardous waste regula-tions. You are considered an LQG if you generate more than 2,200 lbs(1,000 kg) of hazardous waste or morethan 2.2 lbs (1 kg) of acute hazardous waste per calendar month. To assistyour business in learning about theserequirements, the U.S. EnvironmentalProtection Agency (EPA) has preparedthis summary fact sheet.

ou must determine if any of thesolid wastes you generate arehazardous so that you will be able tomanage, report, and track themproperly. Hazardous wastes can be:

Listed wastes.
These wastes willappear on one of four lists pub-lished in 40 CFR Part 261.
n
n
Characteristic wastes.
Certain wastes are considered hazardous if they are ignitable, corrosive,reactive, or toxic.To determine if your wastes exhibita characteristic, you may use EPA-approved test methods or apply yourknowledge of the waste. If waste is tobe land disposed, you must determineif your wastes exhibit any characteris-tics, even if they are listed wastes.Under the Land Disposal Restrictions(LDRs), most hazardous wastes may not be land disposed until they meet“treatment standards.” It is yourresponsibility to ensure that your waste is treated to these standards.To learn about these requirements,call the RCRA Hotline or your stateagencies or Regional Office.

f you are not sure if you are anLQG, you should measure theamount of hazardous waste yougenerate per calendar month. Be sureto measure wastes that are:

 Accumulated on site for any timebefore disposal or recycling.

n
Placed directly into an on-sitetreatment or disposal unit.
n
n
Generated as still bottoms orsludges and removed fromproduct storage tanks.
Obtaining an EPAIdentification Number

dentification numbers are requiredfor persons that generate or man-age hazardous waste, including smalland large quantity generators, trans-porters, and treatment, storage, anddisposal facilities. You will need anEPA identification number for eachsite that generates hazardous waste.To find out where to call to obtainan identification number, contact theRCRA Hotline. Once you have con-tacted the proper authority, you willbe sent EPA Form 8700-12,Notification of Regulated Waste Activity. Fill out the form and send itto the contact listed with the form. An EPA identification number willbe returned to you for each location.
Preparing HazardousWaste for ShipmentOff Site

ou must package, label, andmark your waste containers andplacard vehicles that carry the wastes,following Department of Transportation (DOT) HazardousMaterials Transportation Act require-ments (49 CFR Parts 172, 173, 178,and 179). Commercial waste han-dlers can advise you on the properprocedure, but you remain responsi-ble for compliance.For further information, call theDOT Hazardous MaterialsInformation Line at 202 366-4488.
Obtaining a Manifest

hazardous waste manifest mustaccompany all hazardous wastethat is shipped off site. A manifest isa multipart form designed to track hazardous waste from the time itleaves the generation site until itreaches the TSDF specified on themanifest. The manifest will help youto track your waste during shipmentand make sure it arrives at the properdestination. You should use the manifest formfrom the destination state. If thedestination state does not print themanifest form, then use one fromthe state of origin or another source,if the state of origin does not printthe manifest. The federal form is theUniform Hazardous Waste Manifest(EPA Form 8700-22). The trans-porter and the permitted facility thattreats or disposes of your waste mustsign the manifest and send a copy back to you.
 
Managing HazardousWaste On Site

ou may accumulate any quantity of waste in containers, tanks, drippads, and containment buildings for upto 90 days without a permit, providedthat you meet the technical standardsfor the containment unit. LQGs thatmeet all technical standards for haz-ardous waste accumulation also may treat the waste without obtaining aRCRA permit. Generators must clearly mark the date that accumulation beginson each container storing hazardous waste so that it is visible for inspection.LQGs are also responsible forcomplying with “preparedness andprevention” requirements in the eventof emergencies. In addition, you mustprepare a written contingency planand train employees on hazardous waste management and emergency response.If your facility accumulates wastesfor more than 90 days, it is consid-ered a storage facility and must follow regulations described in 40 CFR Parts264 and 270, unless you have beengranted an extension by your EPA Regional Administrator.
Reporting

Biennial Reporting

ou are responsible for submittinga Biennial Report to your EPA Regional Office. Reports submittedfor offsite shipping must include yourEPA identification number, informa-tion for the transporter and permittedfacility, a description and quantity of  waste, actions you have taken toreduce the volume and toxicity of the waste, and the results of thoseactions. These reports give EPA abetter understanding of nationalhazardous waste generation anddisposal. They can also be used topromote pollution prevention. Somestates might require you to reportannually.If you only export hazardous wastes, you are not required tosubmit a Biennial Report. You do,however, have to submit an annualreport (40 CFR 262.56). Call theRCRA Hotline for more information.
 Exception Reporting

f you do not receive a signed mani-fest from the final destination of your hazardous waste:

n
 After 35 days, you must attemptto locate the hazardous waste by contacting the permitted facility.
n
n
 After 45 days, you must submit toyour EPA Regional Office anException Report that contains acopy of the original manifest anda cover letter describing yourefforts to locate the shipment andthe results of your efforts.
