2012 _______ AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE TOWNSHIP OF LONDONDERRY, DAUPHIN COUNTY, PENNSYLVANIA, AMENDING THE CODE OF ORDINANCES, NO. 912, AS AMENDED AND SUPPLEMENTED, CHAPTER 18, SEWERS AND SEWAGE DISPOSAL, PART 1, INDIVIDUAL AND COMMUNITY SEWAGE AND DISPOSAL SYSTEMS, IN ITS ENTIRETY AND REPLACING IT WITH A NEW PART 1 TITLED ONLOT SEWAGE DISPOSAL SYSTEM (OLSDS) MANAGEMENT ESTABLISHING REGULATIONS FOR INSTALLATION, INSPECTION AND MAINTENANCEOFONLOT SEWAGEDISPOSALSYSTEMS,ANDREQUIRINGREGISTRATIONOF SEPTAGEPUMPER/HAULERBUSINESSES

TheBoardofSupervisorsoftheTownshipofLondonderry,intheCountyofDauphinandtheCommonwealthof Pennsylvania,herebyordains andenactsasfollows: SECTION1: TheCodeofOrdinancesoftheTownshipofLondonderry,DauphinCounty,Pennsylvania,No. 912,asamendedandsupplemented,CHAPTER18,SEWERSANDSEWAGEDISPOSALPART1,Individualand CommunitySewageDisposalSystems,isherebyamendedinitsentiretytoreadasfollows: PART1 OnLotSewageDisposalSystem(OLSDS)Management SECTION 101: TITLE This Article shallbeknownasandmaybereferredtoasthe Londonderry Township"OnLotSewageDisposalSystem (OLSDS)ManagementOrdinance." SECTION 102: PURPOSE Thepurposeofthis Article includes: 1. Regulation of the installation, inspection, operation, rehabilitation, replacement and timely ongoing maintenanceof OLSDSswithintheTownship Establishment of provisions and safeguards for the Township which enable the issuance of permits for OLSDSsbyandthroughtheSewageEnforcementOfficer(SEO) Registrationofpumper/haulerbusinessesthatremoveanddispose ofseptage Establishmentofminimumstandardsfortheperiodicpumping,treatment,dosingandliftpumptankswhich arecomponentsofOLSDSs Adoptionofstandardsforinspectionandpumpingofsystemsandtanksand Provision for the Township to take action to correct conditions which are declared public nuisances or hazardstothepublichealth.

SECTION 103: LEGISLATIVEINTENT 1. As mandated by the municipal codes, the Clean Streams Law (35 P.S. 691.1 to 691.1001), and the PennsylvaniaSewageFacilitiesAct[ActofJanuary24,1966,P.L.(1965)1535,No.537,asamended,35

P.S.750.1etseq.,knownas"Act537"],municipalitieshavethepowerandthedutytoprovideadequate sewagetreatmentfacilitiesfortheprotectionofthepublichealthbypreventingthedischargeofuntreatedor inadequatelytreatedsewage.TheBoardofSupervisorsrecognizesthatindividualandcommunityOLSDSs constituteavalidandapprovedmannerofprotectingthequalityofthewaterandothernaturalresourcesof theTownshipthroughpropertreatmentofwastesgeneratedbycertaindevelopmentwithintheTownship. TheuseofOLSDSsmustberegulatedinaccordancewiththeregulationspromulgatedbythePennsylvania Department of Environmental Protection (DEP), which pertain to the location and permitted types of OLSDSs.Inaddition,theTownshiphasdeterminedthat,shouldtheOLSDSsinstalledbyalandownerfail, therebyendangeringthehealthandwelfareoftheresidentsandvisitors,theBoardof Supervisorsdesiresto requirethatalllandownersprovideandsetasideareasfortheinstallationofreplacementindividualOLSDSs. 2. ItisthefurtherintentoftheBoardof SupervisorstoinsurethatOLSDSsareproperlymaintained.Failureto maintain an OLSDS can eventuateintoa pollution of the groundwater and othernaturalresources of the Township.OLSDSsmustbepumpedonaregularbasistoensuresuchmaintenanceisperformed.Inorderto determinethatOLSDSswithintheTownshiparebeingmaintainedproperly,alllandownersusingOLSDSs shallfilemanifestswiththeTownshipconcerningsuchservice.Thepumpers/haulersshallalsoberequiredto reportanyOLSDStotheTownshipwhichispollutinggroundwater,surfacewatersordischargingsewageto thesurfaceoftheground.

SECTION 104: ADOPTIONOFSTANDARDSBYREFERENCE Chapters71,72,and73ofTitle25ofthePennsylvaniaCode,aspromulgatedbytheDEP,areherebyadoptedasthe sewagepermitapplicationandinstallationprocedureoftheTownship,andeachandalloftheregulationscontainedin thesaidchaptersareherebyadoptedbytheTownship,exceptasspecificallymodifiedbythis Article.Itistheintentof theBoardof Supervisorstoadoptautomatically,withoutfurtheractionoftheBoard,allsubsequentamendmentsand revisionstothesaidchaptersaspermittedbylawandinaccordancewiththeprovisionsof1Pa.C.S.A.1937(a).If suchintentisfoundinvalidbyacourtofcompetentjurisdiction,itistheintentoftheBoardtoadoptthesaidchapters astheyexistedontheeffectivedateofthisArticle. SECTION 105: WORDUSAGE,DEFINITIONS 1. Generalterms.IntheinterpretationofthisArticle,thesingularshallincludetheplural,andthemasculine shallincludethefeminineandtheneuter. Specific terms. For the purposes of this Article, the terms used shall be construed to have the following meanings: ACT ThePennsylvaniaSewageFacilitiesAct,ActofJanuary24, 1966,P.L.(1965)1535,No.537,asamended,35 P.S.750.1etseq. ADSORPTIONAREAEASEMENT Aportionofalot,tract,orparcelthatencompassesthePrimaryandReplacementAreasandwhichshallbe delineatedandpreserved. ThePrimaryand ReplacementAreasneednotbecontiguous. ALTERNATIVESYSTEM Asystemforthedisposalofdomesticwastewatersnotoperatingbelowgroundlevelbutlocatedonornear the site of the building or buildings being served (e.g., compostingtoilets, gray waterrecycling systems,

incineratingtoilets,sprayirrigationandblackwaterrecyclingsystems,etc.). AUTHORIZED AGENT A licensed sewage enforcement officer, professional engineer or sanitarian, plumbing inspector, soils scientist,oranyotherqualifiedorlicensedpersonwhoisdelegatedtofunctionwithinthespecifiedlimitsas theagentoftheBoardof Supervisorsof Londonderry Townshiptocarryouttheprovisionsofthis Article. BOARD

TheBoardof SupervisorsoftheTownshipof Londonderry,DauphinCounty,Pennsylvania. CESSPOOL Acoveredpitwithopenjointedliningwhichreceivesthesewageorotherorganicwastesdirectlyfroma buildingdrainorbuildingsewer.Thepitretainsthesolidwastesandallowstheliquidwastetopassthrough itsbottomandsides. COMMUNITYSEWAGESYSTEM Anysystem,whetherpubliclyorprivatelyowned,whichcollectssewagefromtwoormorelotsoruses,and the treatmentand/ordisposal of the sewage occurs on oneor more of the lots oratany other site which complieswithallapplicableregulationsoftheDEP. DEP The Department of Environmental Protection of the Commonwealth of Pennsylvania or any successor agency. DEVELOPER Anyperson,partnershiporcorporationwhicherectsorcontractstoerectabuildingonpropertyownedbyit with the intent to sell the building to some other party upon its full or partial completion, or upon the conveyanceofpropertyonwhichthebuildingistobebuilt. GRAYWATER Usedwaterfromalaundry,bath,orkitchensink. INDIVIDUALSEWAGESYSTEM Anysystemofpiping,tanks,orotherfacilitiesservingasingleresidentialunitandcollectinganddisposing ofsewage,inwholeorinpart,intothesoiloranywatersoftheCommonwealthofPennsylvaniaorbymeans ofconveyancetoanothersiteforfinaldisposal. LANDDEVELOPMENT Anyofthefollowingactivities: 1. Theimprovementofonelotortwoormorecontiguouslots,tractsorparcelsoflandforanypurpose involving: 3

Agroupoftwoormoreresidential ornonresidentialbuildings,whetherproposedinitially or cumulatively, or a single nonresidential building on a lot or lots, regardless of the numberofoccupantsortenureor Thedivisionorallocationoflandorspace,whetherinitiallyorcumulatively,betweenor amongtwoormoreexistingorprospectiveoccupantsbymeansoforforthepurposeof streets,commonareas,leaseholds,condominiums,buildinggroupsorotherfeatures.

Asubdivisionofland. DevelopmentinaccordancewithSection503(1.1)oftheMunicipalitiesPlanningCode (Act170of 1988,asamended)

LOT Adesignatedparcel,tract,orareaoflandestablishedbyaplotorotherwiseaspermittedbyandtobeused, developedorbuiltuponasaunit. MALFUNCTION AconditionwhichoccurswhenanOLSDSdischargesontothesurfaceoftheground,intogroundwaterof thisCommonwealth,intosurfacewatersofthisCommonwealth,backsupintoabuildingconnectedtothe systemorinanymannercausesanuisanceorhazardtothepublichealthofpollutionofgroundorsurface water or contamination of public or private drinking water wells. Systems shall be considered to be malfunctioningifanyconditionnotedaboveoccursforanylengthoftimeduringanyperiodoftheyear. MANAGEMENT PROGRAM ThemanagementprogramshallencompasstheentireareaofLondonderryTownshipwherepublicsewage disposal service is not available and wastewater service is provided by OLSDS or any other alternative system whichdischargesintothesoilsoftheTownshiporthewatersoftheCommonwealth.Allsystems shallbeoperatedunderthejurisdictionoftheTownshipandotherapplicablelawsoftheCommonwealthof Pennsylvania. OFFICIALSEWAGEFACILITIESPLAN AcomprehensiveplanfortheprovisionofadequatesewagedisposalsystemsadoptedbytheTownshipand approvedbyDEPinaccordancewiththeActandwithapplicableDEPregulations. ONLOTSEWAGE DISPOSALSYSTEM(OLSDS) Anysewagesystemdisposingofsewage,inwholeorinpart,intothesoilof thelotitservesoranywatersof theCommonwealthofPennsylvania. Thistermincludesbothindividualsewagesystemsandcommunity sewagesystems. OWNER Anypersonvestedwithownership,legalorequitable,soleorpartial,ofanyownedproperty.

PERSON Anyindividual,company,association,society,trust,corporationorothergrouporentity. PLANNINGMODULEFORLAND DEVELOPMENT Arevisionto,orexceptiontotherevisionof,theofficialsewagefacilitiesplanoftheTownship,submittedin connection with the request for approval of a subdivision or land development in accordance with DEP regulations. POLLUTION/POLLUTING Thedischargeofraworpartiallytreatedsewagetothesurfacewater,groundwater,orsurfaceoftheground. PRIMARYAREA Anareaonalot,tractorparceloflandthathasbeentestedbytheSEOandfoundsuitable,baseduponthe thencurrent DEP site requirements, for the installation of an OLSDS and which will be preserved and protected from alteration for installation of the initial OLSDS for sewage generated on that lot, tract, or parcel. PUMPER/HAULER A person who engages in cleaning any or all components of a community or individual OLSDS and evacuatesandtransportsthesewagecleanedtherefrom,whetherforafeeorfreeofcharge,andiscertifiedby thePennsylvaniaSepticManagementAssociationtoperformonlotmanagementtreatmentinspections. PUMPER/HAULERBUSINESS Anysoleproprietor,company,partnershiporcorporationwhichengagesincleaninganyorallcomponents ofacommunityorindividualOLSDSandevacuatesandtransportsthesewagecleanedtherefrom,whether forafeeorfreeofcharge,andregisteredtodobusinesswiththeTownship. PUMPER'SREPORT Aform,providedbytheTownship,whichshallbeusedbyallpumpers/haulerstoreporteverypumpingofan OLSDSintheTownship. REHABILITATION Workdonetomodify,alter,repair,enlargeorreplaceanexistingOLSDS. REPAIR Workdonetomodify,alter, repairorenlargeanexistingOLSDS. REPLACEMENT AREA AnareadesignatedasthefuturelocationofanOLSDSthatshallbeinstalledshouldtheinitialOLSDSfailor otherwisebecomeinoperable.TheareashallmeetalltheregulationsofDEPandallapplicableTownship ordinancesforanOLSDS.

SEPTAGE Theresidualscum,sludgeandothermaterialspumpedfromsepticoraerobictreatmenttanksandthesystems theyserve. SEWAGE Any substancethat contains gray water, waste products, excrement or otherdischarge from the bodies of humanbeings,oranynoxiousordeleterioussubstanceharmfultopublichealth,toanimaloraquaticlife,to theuseofwaterfordomesticwatersupplyorrecreationorwhichconstitutespollutionundertheActof June 22,1937(P.L.1987,No.94),knownasthe"CleanStreamsLaw,"asamended. SEWAGEENFORCEMENTOFFICER(SEO) ApersoncertifiedbytheStateBoardfortheCertificationofSewageEnforcementOfficers,whoisappointed by the Board to administer the provisions of this or any other ordinance adopted by the Township, the provisionsoftheAct,andtheregulationsinPa.CodeTitle25,Chapters71,72and73. SEWAGEFACILITIES Anymethodofsewagecollection,conveyance,treatment,anddisposalwhichwillpreventthedischargeof untreatedorinadequatelytreatedsewageintothewatersofthe Commonwealthorotherwiseprovideforthe safeandsanitarytreatmentofsewage. SEWAGEMANAGEMENTPROGRAM Acomprehensivesetoflegalandadministrativerequirementsencompassingtherequirementsofthis Article, theSewageFacilitiesAct,theCleanStreamsLaw,theregulationspromulgatedthereunderandsuchother requirementsadoptedbytheBoardtoeffectivelyenforceandadministerthis Article. SHALLOWROOTEDPLANTMATERIAL Plantswithrootsnot normallyextendingbeyondtwelve(12)inchesbelowgroundlevel. SINGLEANDSEPARATEOWNERSHIP Theownershipofalotbyoneormorepersons,whichownershipisseparateanddistinctfromthatofany abuttingoradjoininglot. SUBDIVISION Thedivisionorredivisionofalot,tractorparcelofland,byanymeans,intotwoormorelots,tracts,parcels or other divisions of land, including changes in existing lot lines for the purpose, whether immediate or future,oflease,partitionbythecourtfordistributiontoheirsordevisees,transferofownershiporbuildingor lot development provided, however, that the subdivision by lease of land for agricultural purposes into parcelsofmorethan10acres,notinvolvinganynewstreetoreasementofaccess oranyresidentialdwelling, shallbeexempted.

TOWNSHIP TheTownshipofLondonderry,DauphinCounty,Pennsylvania,aPennsylvaniamunicipality,actingbyand through its Board of Supervisors and, in appropriate cases, acting by and through its authorized representatives. TREATMENTTANK A watertight tank designed to retain sewage long enough for satisfactory bacterial decomposition of the solidstotakeplace.Thetermincludesthefollowing: 1. SEPTICTANK Atreatmenttankthatprovidesforanaerobicdecompositionofsewagepriortoits discharge. AEROBICSEWAGETREATMENTTANK Amechanicallyaeratedtreatmenttankthatprovides aerobicbiochemicalstabilizationofsewagepriortoitspoint ofdischarge.

Allotherdefinitionsof wordsandtermsusedinthisArticleshallhavethesamemeaningsassetforthin Chapter73,StandardsforSewageDisposalFacilities,ofTitle25,RulesandRegulations,DEP.

SECTION 106: APPLICABILITY FromtheeffectivedateofthisArticle,itsprovisionsshallapplytoallpersonsowninganypropertyservicedbyan individualorcommunityOLSDSandtoallpersonsinstalling,repairingorrehabilitatingsuchsystems.Theaforesaid notwithstanding,the Boardof Supervisors may,initssolediscretion,provideagraceperiodforimplementationofthe provisionsofthisArticletopersonswhowillberequiredtoconnecttotheTownship'scommunitysewercollection andtreatmentsystem. SECTION 107: PERMITREQUIRED 1. Nopersonshallinstall,constructoralteranindividualsewagesystemorcommunitysewagesystemorinstall oroccupyanybuildingorstructureforwhichanindividualsewagesystemorcommunitysewagesystemisto be installed without first obtaining a permit from the Sewage Enforcement Officer of Londonderry Township, indicating that the site, plans and specifications of such system are in compliance with the provisionsofthePennsylvaniaSewageFacilitiesAct(ActofJanuary24,1966,P.L.1535,asamended,35 P.S.750.1etseq.)andtherulesandregulationsadoptedbytheDepartmentofEnvironmentalProtection pursuantthereto.Apermitshallberequiredregardlessofthesizeofthelotortractofgroundonwhichthe buildingorstructureistobeconstructed,alteredoroccupied. Building and zoning permits shall not be issued for any building or improvement to real property to be servicedbyanonlotsystem,priortoreceivingapermitfortheinstallationoftheOLSDSfromtheSEO. Allsystemcomponentsincludingadsorptionareasshouldbelocatedonthesamelot,tract,orparcelasthe structure they will serve. Systems or componentsshouldnot be located on a separately deeded parcel if possible. Ifspecificcircumstancesrequireanonlotsystemtobelocatedonaparcelotherthanthatofthe structure it serves, it may be located on a separate parcel through the establishment of a duly recorded easement,rightofway,orotherinstrument. AllplanningmodulesproposingindividualorcommunitysewagesystemswhichrequireaDEPpermitshall include a provision granting the Township and its agents the right to enter the premises to inspect the construction and/or operation of the DEP permitted system, andif the system isnot being constructed or operated accordingtothe permitteddesign, issuea stop work order orrevoke the occupancy permit until 7

constructionoroperationisbroughtintocompliancewiththepermit. 5. Followingtheinstallation,butbeforetheoperationoruseofallsewagefacilitiesinstalledintheTownship, whetherpermittedbytheSEOorDEP,theapplicationshallsubmittotheTownshipanasbuiltdrawing(s)of theentiresystem. A. Allasbuilt drawings shall be drawnto the same scale andwith the same detail as the drawings whichweresubmittedaspartofthe applicationforthepermittoinstallthesewagefacility. At a minimum, the following components shall be located by actual field measurements of the finishedcomponentslocationtotwoimmovablepointssuchas,butnotlimitedto,buildingcorners, bridgeabutments,propertycornermonumentsorsimilarfeatures: (1) Fourcornersofeachbedtypeabsorptionsystem. (2) Fourcornersofeachtrenchinatrenchtypeabsorptionsystem. (3) Inletobservationportsofalltreatment,dosing,siphon,process,surge,orothertanks. (4) Distributionboxes. (5) Chlorinepumps,tablechlorinators. (6) Chlorinestoragesitesforliquid,solid,orgaseouschlorine. (7) ContactTanks Distancesmaybeincorporatedinthedrawinginassociationwithanarrowbetweentherespective pointsorpresentedinthecontextofatable. SECTION 108: ISSUANCEOFPERMIT Noperson,firmorcorporationshallconstruct,alterorextendanyindividualorcommunitysewagedisposalsystem withintheTownshipof Londonderry,DauphinCounty,Pennsylvania,unlesshe/sheholdsavalidpermitissuedbythe person or officer charged withthe issuance thereof. Permits shall beissued, ifthey comply withthe Pennsylvania Sewage Facilities Act andtherules andregulations issuedin connectiontherewith, upon thepayment of a fee as designatedbythe Supervisorsof Londonderry Township. SECTION 109: APPEALS 1. AnyaggrievedpartymayappealtotheBoardforrelieffromthestrictapplicationoftheprovisionsofthis Article,whensuchconstituteademonstrable hardship. Appealsshall: A. B. C. Proposealternatemethodsorprovisionsthatwill,tothegreatestextent possible,attainthepurposes ofthisArticle.

AppealrequestsmustbereceivedbytheBoardwithinfifteen(15)daysoftheactionbeingappealedandmust beaccompaniedbytheappropriatefeesetbyresolutionoftheBoard. Withinfifteen (15)daysofreceiptofanappeal,theBoardshallscheduleapublichearingwhichshallbe conductedpursuanttotheLocalAgencyLaw. TheBoardshallissueitsdecisionwithinfifteen(15)daysoftheendofthehearing. Only in the case of a demonstrated hardship may the Board, in its discretion, grant a variance from the provisionsofthisOrdinance. A. Anysuchvarianceshall,tothegreatestextentpossible,protectthepublichealthandqualityofthe waterresourcesoftheTownship. Whenintheopinionofthe Boarditis necessarytomeetthepurposesofthisArticle,avariancemay beconditioneduponmeasuresnotspecifiedinthisArticle.

Atalltimes,theburdentopresentcredibleevidenceandtheburdenofpersuasionshallbeupontheApplicant seeking relief. RelieffromReplacementAreaRequirement A. Ifanyunimprovedlotheldinsingleandseparateownershipdoesnotcontainsuitablelandforboth aPrimaryAbsorptionAreaandaReplacementAbsorptionArea,thelandownerdesiringtoinstallan individual sewage system may request that the Board grant an exception to the requirement of providingaReplacementArea. At a minimum, landowners seeking relief shall present credible evidence to the Board demonstrating: (1) ThatthelotwasheldinsingleandseparateownershipontheeffectivedateofthisArticle (2) Thesizeofthelot (3) Theresultsofsoilevaluationandtestingthatwereconductedandwhichdeterminethatthesoil conditionsonthelotareofanextentornaturethatonlyaPrimaryAreaexistsonthelotand, (4) Theinabilityoftheapplicanttoacquireadjacentland,ortheunsuitabilityofadjacentlandwhich mightbeabletobeacquired. C. Underthissubsection,theBoardmayconditionreliefonamorefrequentpumpingschedule,useof waterconservationmeasuresorotherappropriatemanagementtechniques.

SECTION 110: DUTIESOFSEWAGEENFORCEMENTOFFICER(SEO) TheSEOofLondonderryTownshipshallissuepermits,reviewpermitapplicationsandsewagefacilitiesplanning modules and conduct investigations and inspections necessary to implement the Sewage Facilities Act and the regulationsthereunder.Morespecifically,dutiesoftheSEOshallincludethefollowing:

Issue,denyorrevokesepticsystempermitsinaccordancewithstateregulationsandstandards. Reviewsoilprofiles(deepprobes)andpercolationtests. Inspectnewlyinstalledsystemstoensureproperinstallation. Conduct initial septic system site investigations to document conditions, determine the causes of malfunctions,anddecidetheextentoftherepairneededtoresolvesepticsystemmalfunctionproblems. Issueanoticeofviolationtotheresponsiblepropertyownerforafailedsepticsystemandissueasewage permitapplicationforthepropersystemrepair. Issue the responsible property owner a permit to repair or replace the malfunctioning system after any necessarysitetestinghasbeendoneandanacceptablesystemdesignhasbeensubmitted.

SECTION 111: SYSTEMMARKERSACCESSTOSYSTEM 1. Anypersonwhoshall installanewOLSDSshalluseundergroundwarningtapetoidentifythelocationofall treatmenttanksandappurtenances.Theundergroundwarningtapeshallbeburiedsixinchesbelowfinished grade. The underground warning tape shall be magnetic polyethylene tape, three inches in width, with a minimumletteringofoneinch. Inaddition,amanholeriserandcovershallbeinstalledonallnewseptictankstoenableeasyaccess.The risershall extend tothesurface.Amechanismtopreventunlawfulentryshallbeinstalledonthecoverifitis broughttothesurface.

SECTION 112: REPLACEMENTAREAS 1. Requirements. A. AreplacementareaforanindividualorcommunityOLSDSshallbeprovidedforalllotswhichare notservicedbypublicsewer.LotsthatareservedbyanOLSDSthatexistedpriortotheeffective dateofthisArticle shallbeexemptfromtherequirementsofthissubsection. allsoiltestsrequiredinChapter73oftheActforthelocationofanOLSDS. B. ThelocationoftheinitialOLSDSandthereplacementarea(s),asconfirmedbytheSEO,shallbe delineatedandidentifiedasanabsorptionareaeasementonaplotplananddiagramsubmittedas partofthepermitapplication. Iftheapplicationisforsubdivisionorlanddevelopmentplanapprovaloraspartofarequestthatthe Townshipapproveaplanningmoduleforlanddevelopmenttoamenditsofficialsewagefacilities plan, or approval of a request for a planning exemption to the revision of the official sewage facilitiesplan,thelocationofeachinitialOLSDSandeachreplacementareashallbenotedasan absorptionareaeasementupontheplans.Iftheapplicationisforsubdivisionorlanddevelopment approval,anoteshallalsobeaddedtotheplansstatingthatnoimprovements,whetherpermanentor temporary,shallbeconstructeduponorwithintheprimaryareaandreplacementarea(absorption areaeasement),withtheexceptionofthoseidentifiedinSubsection3 hereinbelow. Thedescription,including metes andbounds,oreveryabsorptionareaeasementshallberecordedas partofthedeedforeachlotcreatedaspartofasubdivisionorlanddevelopmentplan. An owner may submit a written request for planning exemption to submit a sewage facilities planning module for any new lot using the application mailer as provided for by the Act said requestmustbeapprovedbytheTownshipandtheDEP. Anyrevisionstoapermitorplanaffectingareplacementareawhichpreviouslyhasbeenapproved pursuanttotheprovisionsofthis Article shallbereviewedforapprovalbytheSEOandforwarded totheBoardof Supervisorsandtheownerforfinalapproval.

Constructionrestrictions. A. Thesitefortheprimaryareaandreplacementareashallbeprotectedandanoteaddedupontheplan statingthat: (1) No permanent or temporary improvements of any character, other than shallowrooted plantmatter,shallbeconstructeduponorwithintheabsorptionareaeasement. No permanentortemporaryalterations,grading,excavation,stockpilingofanysoilorany othermaterialshalltakeplaceuponorwithintheabsorptionareaeasement. During any construction or other activities, the absorption area easement shall be so marked to prevent equipment with greater wheel loading than a common garden tractor/ridingmowerfromtravelingoveroroperatinguponthesurfaceoftheabsorption areaeasement.

SECTION 113: OPERATIONOFSYSTEM 1. All OLSDS shall be operated by the ownerinamannerthatis in full compliance withthe terms of this ' Article,theDEPRegulations,andthesystem spermit. OnlysewageshallbedischargedintoanOLSDS. No OLSDS shall be used orloaded in amanner whichis inconsistent with the permit that was issuedto authorizethatsystemsinstallation. provide convenient access for inspection, maintenance and pumping, and divert surface water and downspoutsawayfromtheabsorptionareaandsystemcomponents. 3. In the event an owner detects conditions that indicate or could reasonably be interpreted to indicate the OLSDSisnotoperatingproperly,theownershallcontact theSEOand,ifrepairorreplacementisnecessary, applyforandobtainapermittorepairorreplacethesystem. Everytreatmenttankorcesspoolshallbepumpedoutaccordingtothepumpingschedulein Section115.2 of thisArticle.Ifacomponent'smanufacturerrequiresamorefrequentpumpingintervalthancontainedinthis Article,thatintervalshallbedeemedtheminimumintervalforpumping. Whenatreatmenttankispumpedout,alldosingtanks,sandfiltertanks,lifttanksandothertanksassociated withthesystemshallalsobepumpedout.

SECTION 115: MAINTENANCEDISTRICTSCREATEDPUMPINGANDINSPECTIONSCHEDULE 1. After the initial pumping/inspection, all treatment tanks or cesspools in an OLSDS shall continue to be pumpedoutataminimumregular intervalofonceevery four yearsfromtheyearofeithertheinitialpumping orasubsequentpumping.Treatmenttanksthathavebeensubjecttomorefrequentpumping,bythenatureof theirsize,loadingrateorothersystemcharacteristics,shouldcontinuetoreceivethatfrequencyofpumping. AfterthecompletionofthefirstcycleofinspectionsassetforthinSection115.2above,theTownshipmay allow treatmenttanksto be pumped outat less frequent intervals whenthe owner candemonstrate tothe TownshipthatthepropertytheOLSDSservesisnotoccupiedonafulltimebasis,orforotheracceptable reasons. Such a request may be made at any time and must be in writing. The Township, in making its determination,shalltakeintoaccounttheinformationsubmittedbytheapplicant,theseweragepermitissued bytheSEO,andany othersupportingdocumentationorinformation.TheTownshipmayalsoconductan onsite inspection of the OLSDS to verify its current condition. The applicant shall bear the cost of any inspectionorsoilandwatersamplingconductedforthepurposesofevaluatingtherequest. TherequiredpumpingfrequencymaybeincreasedatthediscretionoftheTownshipifthetreatmenttankis undersized,ifsolidsbuildupisaboveaverage,ifthehydraulicloadonthesystemincreasessignificantly,ifa garbagegrinderisused,ifthesystemmalfunctions,orifthetreatmenttankisfilledwithsolidsinexcessof 1/3oftheliquiddepthofthetankorwithscuminexcessof1/3oftheliquiddepthofthetank.

SECTION 116: PROCEDUREFORPUMPING/INSPECTION 1. Each pumper/hauler shall have a person, certified by the Pennsylvania Septic Management Association, presentduringtheinitialandsubsequentpumpingtoinspect,observe,confirm andreportontheconditionof theOLSDS. Uponcompletionofeachrequiredpumping,thepumper/haulerbusinessshall: A. B.

The pumper's report shall be on a Townshipprovided form, which is incorporated by reference into this Articleas Appendix2,and asmay be amended fromtimeto time without therequirementto amend this Article.The pumper'sreportshallincludetherequiredinformationasoutlinedonAppendix2. Should the pumping/inspection reveal that the OLSDS is polluting the groundwater or surface waters or dischargingtothesurfaceoftheground,thepumper/haulershallnotifytheTownship,whoshallnotifythe ownerinaccordancewiththisordinance totakecorrectiveactionofthepollution. Intheeventthatanownerfailstocarryouttherequirementsfortheinitialorsubsequentpumping/inspection, theSEOshallhavetherighttoenteruponlandforthepurposeofconductinginspectionsrequiredbythis Article. TheSEOshallmakeanefforttocontacttheowner,currenttenant,orboth,inwriting,priortoconductingthe inspection.Thenoticeshallincludethe dateandtimeoftheinspectionandthereasonfortheinspection.Ifthe ownerortenantcannotbereachedand,inthejudgmentoftheSEO,thereisanimmediateandsubstantial safety, water pollution or health hazard, the SEO may enter upon the property and proceed with the inspectionoftheOLSDS. NoprovisionofthisArticleshallrequirenoticetobegivenbeforeentrywhereitcanbeobservedfroma public street or abutting property (with the consent of the abutting property owner) that an OLSDS is polluting. Any OLSDS or an alternative system which contains an aerobic sewage treatment tank shall follow the operatingandmaintenancerecommendationsoftheequipmentmanufacturer.Acopyofthemanufacturer's recommendationsandacopyoftheservice agreementshallbesubmittedtotheTownshipwithinsixmonths oftheeffectivedateofthisArticle.Thereafter,servicereceiptsshallbesubmittedtotheTownshipatthe intervalsspecifiedbythemanufacturer'srecommendations. TheTownshipmayrequireadditionalmaintenanceactivityasneeded,including,butnotnecessarilylimited to,cleaninganduncloggingofpipingservicingandrepairofmechanicalequipmentlevelingofdistribution boxes,tanksandlinesremovalofobstructingrootsortreesanddiversionofsurfacewaterawayfromthe disposalarea.RepairorrehabilitationpermitsissuedbytheSEOmustbesecuredbeforetheseactivitiesare commenced.

SECTION 117: SYSTEMREHABILITATION 1. NopersonshalloperateormaintainanOLSDSinsuchamannerthatitcausespollution.Allliquidwastes, including bathroom, kitchen and laundry wastes and water softener backwash, shall be discharged to a treatmenttank.Nosewagefacilityshalldischargeuntreatedorpartiallytreatedsewagetothe surfaceofthe groundorintothewatersofthecommonwealthunlessapermittodischargehasbeenobtainedfromtheDEP. TheTownshipshallissueawrittennoticeofviolationtoanypersonwhoistheownerofapropertyinthe TownshipwhichisfoundtobeservedbyanOLSDSwhichisdischargingraworpartiallytreatedsewageto thesurfacewater,groundwaterorsurfaceoftheground. Withinfifteen(15) daysofnoticeofviolationbytheTownshipthatpollutionhasbeenidentified,theowner shall makeapplication to theTownship's SEO forarepairorrehabilitation permit toabate thepollution. Within 90 days of the original notification by the Township, construction of the permitted repair or rehabilitationshallcommence.Within120daysoftheoriginalnotificationbytheTownship,therepairor rehabilitationshallbecompleted,unlessseasonaloruniqueconditionsmandatealongerperiod,inwhich casetheTownshipmaysetanextendedcompletiondate. TheTownshipshallcompel,ormaytake,immediatecorrectiveactionwheneverthepollutionrepresentsa publichealthhazardorenvironmentalthreat.IntheeventtheTownship,oritsagentsorcontractors,takes suchcorrectiveaction,theownerofthepropertyshallbechargedforthecostsofwork,andrelatedexpenses, performedbytheTownship,oritsagentsorcontractors,whichcostsshallbecomealienonthepropertyand shallberecoveredandcollectedbytheBoardofSupervisorsbythefilingofamunicipalclaiminrelationto theproperty,reducingsaidclaimtojudgmentandexecutinguponsuchjudgment,orbyinstitutingasuitto recoversuchcostsorexpensestobechargedagainstthepropertyasalienoragainstthepersonorlegalentity asapersonaljudgment. TheTownship'sSEOshallhavetheauthoritytorequiretherepairorrehabilitationofanypollutionbythe followingmethods:cleaning,repairorreplacementofcomponentsoftheexistingsystemaddingcapacityor otherwisealteringorreplacingthesystem'streatmenttankexpandingtheexistingdisposalareareplacing the existing disposal area replacing a gravity distribution system with a pressurized system or other alternativesasappropriateforthespecificsite,inaccordancewiththeAct. InlieuoforincombinationwiththeremediesdescribedinSubsection 5,theSEOmayrequiretheinstallation ofwaterconservationequipmentandtheinstitutionofwaterconservationpracticesinstructureshavingan OLSDS. Waterusing devices and appliances in the structure may be retrofit with watersaving appurtenances,ortheymaybereplacedbywaterconservingdevicesandappliances.Wastewatergenerated inthestructuremayalsobereducedbywaterusagepatternsinthestructureserved. IntheeventthattherepairorrehabilitationmeasuresinSubsections1through6arenotfeasibleordonot prove effective, the Owner is not absolved of the responsibility for any negative effects caused by the malfunction, and the Township may require the owner to apply for a permit to install a holding tank in accordance withTownship Ordinance No. 19943B,asamended and supplemented. Uponreceipt of said permit,theownershallcompletetheinstallationoftheholdingtankwithin90days,unlessseasonalorunique conditionsmandatealongerperiod,inwhichcasetheTownshipmaysetanextendedcompletiondate.

SECTION 118: WORKPERFORMEDBYTOWNSHIPRECOVERYOFCOSTS TheTownship,uponwrittennoticefromtheSEOthatanimminenthealthhazardexistsdue tofailureofanownerto maintain, repair or rehabilitate an OLSDS as provided under the terms of this Article, shall have the authority to performorcontracttohaveperformedtheworkrequiredbytheSEO.TheTownshipshallretaintherightto reclaim costsinaccordancewithapplicable laws. SECTION 119: RIGHTOFENTRYEASEMENTS 1. AllpermitsfortheinstallationofOLSDSshallbeconditionedupontheinclusionoflanguageinthedeed establishingagrantofRightofEntrybythelandowner,hisheirs,successors,andassignstotheTownship for the limited purpose of inspecting, maintaining, sampling, testing, evaluating or repairing the OLSDS describedintheapplicationandpermit. Thegrantofrightofentrycannotberevoked,suspendedordiscontinuedbythepresentoranyfutureowner. IntheeventthattheOLSDSisabandonedandnotreplacedbyanotherOLSDS,andallsewageiscollected andtreatedatasitenoonthelot,theTownshipshallabandontheeasementandrightofentrywhich thenshall cease.

SECTION 120: PUMPER/HAULERBUSINESSREGISTRATION 1. Each pumper/hauler business providing pumping services to owners of an OLSDS within the Township, includingbutnotlimitedtopumpingouttheOLSDS,shallregisterwiththe Townshipatleastseven(7)days beforeofferingsuchservices.Suchregistrationshallincludebutisnotlimitedtothefollowing: A. B. C. D. Thename,address,andtelephonenumberofthepumper/haulerbusiness. IdentificationofallpersonsthatwillperformtheseservicesintheTownship. Listofallvehicles,includingmake,year,modelandmotorvehicleregistrationnumber. Copy ofinsurancecoverage,withminimumcoveragesasfollows:compliancewiththeWorkers' CompensationAct, andtheSocialSecurityAct,asamended,andliabilityinsuranceinanamountof notlessthan$1,000,000forinjuries,includingaccidentaldeath,toanyonepersonandsubjecttothe samelimitforeachperson,inanamountofnolessthan$2,000,000onaccountofoneaccident, and property damage insurance in an amount of not less than $1,000,000 or $2,000,000 combined singlelimitliability,withanumbrellacoverageof$2,000,000. CopyofmembershipinthePennsylvaniaSepticManagementAssociation. Documentation that thereisat least oneperson employed by the pumper/hauler business who is certified by the Pennsylvania Septic Management Association to perform onlot management treatmentinspections. Identify the location(s) at which the pumper/hauler business proposes to dispose of septage collectedintheTownshipthatshallbevalidforthecalendaryear.

SECTION 121: DISPOSALOFSEPTAGE

AllseptageoriginatingwithintheTownshipshallbedisposedofatsitesorfacilitiesapprovedbytheDEP. Approved sites or facilities shall include the following: septagetreatment facilities, wastewater treatment plants,compostingsites,andDEPapprovedfarmlands. Allpumpers/haulersoperatingwiththeTownshipshalloperateinamannerconsistentwiththeprovisionsof Pa.Code,Title25,EnvironmentalProtection,Chapter285,andthePennsylvaniaSolidWasteManagement Act(Act97of1980,35P.S.6018.101through6018.1003).

SECTION 122: ADMINISTRATIONANDENFORCEMENTRECORDS 1. The Township shall establish all administrative procedures necessary to carry out the provisions of this Article. The Township may appoint an authorized agent or may contract with private individuals or firms as necessarytocarryouttheprovisionsofthisArticle. All permits, records, reports, files and other written material related to the installation, operation and maintenanceofTownshipOLSDSsshallbecomethepropertyoftheTownship.Existingandfuture records shallbeavailableforpublicinspectionduringregularbusinesshoursattheTownshipoffices.Allrecords pertainingtosewagepermits,buildingpermits,occupancypermits,andallotheraspectsoftheTownship's management program shall be made available, upon request, for inspection, in accordance with the PennsylvaniaOpenRecordsLaw.

SECTION 123: FEES TheBoardmay,byresolution,establishafeescheduleandcollectfeestocovertheTownship'scostsofpermitsand otherwiseadministeringthisArticle. SECTION 124: UNLAWFULACTSVIOLATIONSANDPENALTIES 1. Itshallbeillegaltoconstruct,alter,repairorrehabilitateanOLSDSwithoutfirstobtainingapermitforthe installationorrepairfromtheSEO. Itshallbeillegaltofailto maintainthecomponentsofanOLSDSattheintervalsspecifiedinthisArticleor thosespecifiedbytheequipmentmanufacturer. Itshallbeillegalforapumper/haulerbusinesstofailtoregisterand/orfileallrequiredreportsinatimely mannerasrequiredbythisArticle. Any person who violates any of the provisions of this Article commits a summary offense and shall be subjecttoprosecutionbytheTownshipand,uponconvictionbeforeaMagisterialDistrictJudge,shallbe ' subjecttoafineofnotlessthan$300normorethan$1,000,pluscostsofprosecutionandtheTownship s reasonable attorneyfees. EachdayofacontinuingviolationshallbeconsideredanewandseparateviolationofthisArticleandshall besubjecttoseparatefine. Upon discovery of any violation of this Article, the Township may, at its option, forgo any prosecution hereunder and may grant to the owner a period of up to 30 days to initiate corrective action with the provisionsofthisArticle.Uponfailureoftheownertoaffectsuchcompliance,theTownshipmayinitiate prosecutionashereinabovesetforthortakeactionunder35P.S.750.12(a).

Anypumper/haulerbusinesswhichhasbeenfoundguiltybyaMagisterialDistrictJudgeofviolationsofthis ArticleorwhichfailstocomplywithanyoftheprovisionsofthisArticleorwhichviolatestheconditionsof itsDEPpermitrelatingtothehandling,treatmentordispositionofseptageorofanystatelaworTownship ordinancegoverningitsoperation shallbebarredfromoperatingwithintheTownshipforaperiodofone year. Inadditiontoanyotheractionstoobtaincompliance,theTownshipmayassesscivilpenaltiesasdescribedin theAct.(See35P.S.750.13a.)
