Despite the ElectionCommission givingclearance to the unveilingof saint-poetThiruvalluvar’s statue,Kannada Chaluvali VatalPaksha and otherKannada organisationshave once againsubmitted amemorandum to thecommission asking thatthe event on Sunday bestopped as they claim itamounts to violation ofthe election model codeof conduct.Speaking at ameeting of Kannadaorganisations here onWednesday, VatalNagaraj, President of thePaksha, said an event ofthis kind could not beheld in the light of theAssembly by-electionson August 18 atGovindarajanagar in thecity. Earlier, thecommission had givenclearance on conditionthat no political speech oractivity that would violatethe model code ofconduct, should becarried out at the time ofunveiling of the statue.Mr. Nagarajsaid that the primarymotive behind ChiefMinister B.S.Yeddyurappa’s decisionwas the BruhatBengaluru MahanagaraPalike (BBMP) electionsto be held later thismonth, as the Tamil votebank in the city is asizeable one.Mr. Nagarajreiterated the bandh callgiven by Kannadaorganisations forSunday, besidesannouncing a rally fromKempe Gowda statue toRajbhavan on August 7as a pre-cursor to theevent. More than 10,000people, he said, wereexpected to participate inthe rally.He said that allessential services will bespared on the day of thebandh, which will beenforced from 6 a.m. to 6p.m. He warned theGovernment not to allowpublic buses to ply onSunday.SeveralKannada leaders whoparticipated in themeeting said that statueunveiling should havebeen done only after theappeal against givingclassical language status inKannada, pending beforeTamil Nadu High Court,was withdrawn and theHogenakkal issue wasresolved."If thegovernments are soconcerned about the twoTamil and Kannada saint-poets, Thiruvalluvar andSarvajna, let them publishtheir books in translationand distribute them," saidKodihosalli Ramanna, oneof the activists.

TheMadras High Court hasdirected the Uniongovernment and the UnionPublic ServiceCommission (UPSC) toinduct a person into theIndian Police Service (IPS)in the Tamil Nadu cadre orin another all India service,on the basis of his selectionin Civil ServicesExamination 2001, with allconsequential benefits.Chastising theauthorities for theirslumberous attiude, thecourt ordered that thepetitioner should be treatedas an OBC candidate forthe process.For the allotmentof the cadre, the authoritiescould even create asupernumerary post, sinceall these years thepetitioner had beendeprived of his due, aDivision Bench of JusticesElipe Dharma Rao and T SSivagnanam said whileallowing a writ petition.The petitioner, JLoganathan, submittedthat he belonged to theKannadiyar community,declared OBC in TamilNadu. TheMadras High Court hasgranted interim stay onfurther proceedings on acharge memo issued bythe Deputy Inspector-General of Police, SalemRange, to a headconstable.M Ravi, counselfor the petitioner RSengodan, submittingthat the charge memocontained vague andflimsy allegations,contended that the onlycharge against the headconstable was that hehad not arrested theaccused after registeringa case under sections341, 323 and 324 of theIPC.Further, he hadRajan Sekhar(25) and Simon MichaelJoseph (35), both nativesof Chennai, who arrivedthis morning, werereferred to thechallenging the lowercourt order.Mr Muruganwas disqualified underthe District MunicipalitiesAct on the ground thatwhile he was holding thepost of Chairman of thelocal body, his wife andfather held subsistingcontracts in themunicipality.JusticePalanivelu observed thatthe wife and father of thepetitioner were issuedletters of termination ofnot registered the caseunder the proper penalprovision.Counsel said ineach and every case, theaccused need not bearrested.The concernedPolice Inspector hadobtained further materialfor altering the offence toone under section 307 ofthe IPC. Madras High Court hasfixed August 17 for the finalhearing on a petitionchallenging the ClassicalLanguage status accordedto Kannada language.Though Kannadawas accorded the classicallanguage tag nine monthsago, the official recognitionof the status would take awhile as this was subject toa writ petition filed byadvocate R Gandhi in theMadras High Court.The PublicInterest Litigation (PIL),which challenged the verylegality of the Constitutionof the committee thatrecommended theclassical language statusto Kannada and Telugulanguages, would come upfor final hearing before firstbench of the High Court.Last week, theCentre filed an affidavit,providing a weak defenceof its decision to accordclassical status to Kannadaand Telugu.K V Dhananjay,advocate for TV anchorDeepak Thimmaiah, whohas been impleaded in thecase, said the affidavit wasweak as it had failed to layout the grounds on whichKannada was deservinglygranted the classicallanguage status.Instead, theemphasis was on arguingthat the PIL was notmaintainable, he said.When thematter came up forhearing on June 22,which lasted for fourdays, the UnderSecretary in the UnionMinistry of Cultureargued in the affidavitthat after going throughthe petitioner'sobjections, it was evidentthat he was not qualifiedto question the legality ofthe move as he himselfwas not sufficientlyliterate.Besides,notifications to the effectthat the classical statushas been accorded to thetwo languages were stillbe to issued, hecontended.The affidavitsaid the petitioner hadfiled the petition based onan apprehension that thecommittee constituted forthe purpose might haverecommended thegranting of classicalstatus to Kannada andTelugu. A writ petitionfiled on the basis of anapprehension could notbe maintainable in law, itsaid.''Unless it'sshown that the decisionof constituting thecommittee, as it nowstands, is illegal orsuffers from anyprocedural improprieties,the decision ofconstituting thecommittee cannot befaulted,'' it said.If the courtallows the petition, thestate government won'tbe able to challenge it inthe Supreme Court, as itis not a party in the case.As the PIL challengingthe classical tag toKannada had beenpending in the MadrasHigh Court, the Centrehad not yet released theannaual grant of Rs 150crore that was madetowards promoting aclassical language. Adivision benchcomprising Chief JusticeH L Gokhale and JusticeJyothimani took up thematter for hearing onJune 22. The hearingcontinued for four days ata stretch and wasadjourned without fixinga date.Today, the HighCourt registry listed thematter for August 17 forfinal hearing.R Gandhi hadfiled the writ petition evenbefore the notification toaccord classical status toKannada and Telugu wasissued. When the Centrepointed out, Mr Gandhifiled another petition.

Thilakavathiapproached the Madrashigh court claiming thephotos of her with her babygirl was used without herconsent.The Madras HCtoday ordered the removalof all banners across TamilNadu in one week's time.The Chennai High court judge said that the postersaround the state of themother and daughter mustbe removed or else it willaffect the social status ofthe family. The High Courtsaid, " The poster hascreated serious problemsfor Thilakavathi and herfamily. The poster hasmade it difficult for thefamily to be part of society."Taking a strongstance against the TamilNadu Health Department,the court added, "TheHealth department mustevolve rules for using picsfrom the web. This canoccur when the sun, earthand moon come in astraight line, with the earthin the middle.The August 6event will be the faintestpenumbral eclipse of theyear with a penumbralmagnitude of 0.899. Theeclipse will begin at 4.34am and end at 7.44 am, andthe greatest eclipse will beat 6.10 am. The next lunareclipse, which will be apartial eclipse, will occur onDecember 31.
