SEC. 101. FINDINGS.

Congress makes the following findings:
7
(1) In the United States, gambling and gaming
8
activities, equipment, and operations have tradition-
9
ally been subject to various forms of Federal and
10
State control, regulation, and enforcement, with
11

some form of gambling being permitted in nearly 
1
every State and by many Indian tribes.

(2) The demarcation between games of chance
3
and games of skill is not always clearly drawn, and
4
the treatment and definition of ‘‘games of skill’’ has
5
 varied from jurisdiction to jurisdiction.
6
(3) Millions of people in the United States
7
enjoy competing with other players in poker, chess,
8
 bridge, mah-jong, backgammon, and similar games
9
 where the outcome turns predominantly on the skill
10
of the participants. While each of these games con-
11
tains an element of chance, over any substantial in-
12
terval, a player’s ultimate success is determined by 
13
that player’s relative level of skill.
14
(4) Poker, in particular, enjoys a long tradition
15
in the United States. Poker is part of the cultural
16
and recreational fabric of the United States and has
17
 been since the founding days of the United States.
18
United States poker aficionados have included presi-
19
dents, judges, and statesmen throughout the history 
20
of the United States.
21
(5) Since the development of the Internet, on-
22
line sites offering Internet gambling and similar
23
games have raised numerous policy, consumer pro-
24
tection, and enforcement concerns for the Federal
