These Implementing Rules and Regulations (IRR)of RA 9266 were published in the Official Gazette on 15 November 2004 (pages7709 through 7731, Vol. 100 No. 46), and took effect on 01 December 2004. TheIRRs are only executive issuances and may still be periodically amended by other executive issuances from the PRC, the BOA or other pertinent agencies or by other IRRs of other laws (particularly those approved after 17 March 2004).

Title.This Rules and Regulations shall be known as “THE RULES ANDREGULATIONS IMPLEMENTING THE PROVISIONS OF REPUBLIC ACT NO. 9266”,otherwise known as “THE ARCHITECTURE ACT OF 2004”. For brevity, it maybe cited as “IRR of the Architecture Act of 2004”.SECTION 2. Statement of Policy.

The State recognizes the importance of architects in nationbuilding and development. Hence, it shall develop and nurturecompetent, virtuous, productive and well-rounded professionalarchitects whose standards of practice and service shall be excellent,qualitative, world-class and globally competitive through inviolable,honest, effective and credible licensure examinations and throughregulatory measures, programs and activities that foster theirprofessional growth and development.This “IRR of the Architecture Act of 2004” shall be interpreted,construed, and carried out in the light of the Statement of Policyfound in Section 2 of Republic Act No. 9266, as stated above.SECTION 3. Definition of Terms.As used in this “IRR of the Architecture Act of 2004”, in R.A.No. 9266 or other laws, the following terms shall be defined asfollows:(1)
 
“Architecture” is the art, science or profession ofplanning, designing and constructing buildings in theirtotality taking into account their environment, inaccordance with the principles of utility, strength andbeauty;(2)
 
“Architect” means a person professionally and academicallyqualified, registered and licensed under R.A. No. 9266 witha Certificate of Registration and ProfessionalIdentification Card issued by the Professional RegulatoryBoard of Architecture and the Professional RegulationCommission, and who is responsible for advocating the fairand sustainable development, welfare and culturalexpression of society’s habitat in terms of space, formsand historical context;(a) “Architect-of-record” means the architect registeredand licensed under R.A. No. 9266, who is directly andprofessionally responsible for the total design ofthe project for the client and who shall assume thecivil liability for the plans, specifications andcontract documents he/she has signed and sealed;(b) “Architect-in-charge of construction” means anarchitect registered and licensed under R.A. No.9266, who is directly and professionally responsibleand liable for the construction supervision of theproject;(c) “Consulting Architect” means the architect registeredand licensed or permitted to practice under R.A. No.9266, who is professionally and academicallyqualified and with exceptional or recognizedexpertise or specialization in any branch ofarchitecture;(3)
 
“General Practice of Architecture” the act of planning andarchitectural designing, structural conceptualization,specifying, supervising and giving general administrationand responsible direction to the erection, enlargement oralterations of buildings and building environments andarchitectural design in engineering structures or any partthereof; the scientific, aesthetic and orderly coordination

of all the processes which enter into the production of acomplete building or structure performed through the mediumof unbiased preliminary studies of plans, consultations,specifications, conferences, evaluations, investigations,contract documents and oral advice and directionsregardless of whether the persons engaged in such practiceare residents of the Philippines or have their principaloffice or place of business in this country or anotherterritory, and regardless of whether such persons areperforming one or all these duties, or whether such dutiesare performed in person or as the directing head of anoffice or organization performing them;(4)
 
“Scope of the Practice of Architecture” encompasses theprovision of professional services in connection with site,physical and planning and the design, construction,enlargement, conservation, renovation, remodeling,restoration or alteration of a building or group ofbuildings. Services may include, but are not limited to:(a)
 
planning, architectural designing and structuralconceptualization;(b)
 
consultation, consultancy, giving oral or writtenadvice and directions, conferences, evaluations,investigations, quality surveys, appraisals andadjustments, architectural and operational planning,site analysis and other pre-design services;(c)
 
schematic design, design development, contractdocuments and construction phases includingprofessional consultancies;(d)
 
preparation of preliminary, technical, economic andfinancial feasibility studies of plans, models andproject promotional services;(e)
 
preparation of architectural plans, specifications,bill of materials, cost estimates, general conditionsand bidding documents;(f)
 
construction and project management, giving generalmanagement, administration, supervision, coordinationand responsible direction or the planning,architectural designing, construction,reconstruction, erection, enlargement or demolition,renovation, repair, orderly removal, remodeling,alteration, preservation or restoration of buildingsor structures or complex buildings, including alltheir components, sites and environs, intended forprivate or public use;(g)
 
the planning, architectural lay-outing andutilization of spaces within and surrounding suchbuildings or structures, housing design and communityarchitecture, architectural interiors and spaceplanning, architectural detailing, architecturallighting, acoustics, architectural lay-outing ofmechanical, electrical, electronic, sanitary,plumbing, communications and other utility systems,equipment and fixtures;
