RE: Reinstatement of
Neighbors of the Unit Block of T Street, NW
as Protestant to: License Renewal Application #090832 (Seaton Motor Company, LLC, d/b/a Red Hen, 1822 First St, NW
Dear Ms. Fashbaugh, I am writing in regard to the above noted matter for which I received notice of dismissal by email on September 20, 2013. As noted in that communication, the Neighbors of the Unit Block of T Street, NW have the right to request reinstatement as Protestants in the above noted matter. This letter constitutes such request for reinstatement. In that regard, we would like to first further clarify a few issues noted in the 9/19/13 Board Order of Dismissal: .
The Board Order notes: “On June 6, 2013, ABRA staff mailed the individuals of the Group of Five
or More Individuals a letter informing them to appear in person or provide a written statement
designating a representative who must appear for the Roll Call Hearing on their behalf”. However it is not noted that the Group’s representative was designated as part of the language
of its protest petition (
. Consequently, only the Designated Representative appeared at the June 17 Roll Call Hearing. 2.
The Board Order additionally correctly notes both that A group of Five or More Individuals did not appear at the Status Hearing of August 7, 2013, and its Designated Representative was informed that five such persons must attend the Protest Hearing, which was then scheduled for September 18, 2013 at 5:00 p.m. We also would like to note that Protestants were not
dismissed at the Status Hearing and the Board Chair ruled that “
the process would proceed to
the Protest Hearing” due to the Applicant’s absence
at the Status Hearing. The Neighbors of the Unit Block of T St., NW would also like to affirm to the Board that: (a) it has not willfully or maliciously ignored Board directives, and (b) petition signers were repeatedly informed of the procedures of the Status and Protest Hearings and related requirements for attendance by 5 or more petition signers, and (c) petition signers and others actively contributed to arguments and materials
