MUKASEY: Good afternoon, your Honor. Marc Mukasey12 from the law firm Bracewell & Giuliani for the defendant Frank13 DiPascali, who is seated to my left. With me are Dan Connolly,14 Craig Warkol, and Jamie Renner.15 THE COURT: Good afternoon to each you and to Mr.16 DiPascali.17 Let me just get a little bit of background so it is18 clear since this is the first appearance of anyone on this19 case. On Friday I received a letter from the government, Mr.20 Litt and Ms. Baroni, advising me that the defendant, Mr.21 DiPascali, was prepared to waive the indictment and plead22 guilty pursuant to an information in this case.23 The government also included a notice of intent to24 file an information as opposed to an indictment, as well as a25 motion pursuant to Title 18, United States Code, Section 3771SOUTHERN DISTRICT REPORTERS, P.C.(212) 805-0300
