On 3/8/04 you requested documentation of communication between FAA


and NORAD regarding the release of a briefing that NORAD produced after
9/11 using FAA radar data.

The only documentation we have is email between FAA's Tony Ferrante


and NORAD's Bill Nix and Cherie Gott from March and April 2002. There
was no formal approval process required to release this information.

I left your letter with Mr. Anthony Ferrante and Mr. Tony Mello, they are the Branch heads of the
Investigation Division at FAA HQ. One of them is going to mail and or fax you a copy of the FOIA
Release from the FAA. I'm out of the Office next week. They are cc'd on this so you have their e-mail
addresses to follow up if required.

Hi Maj Nix -
Thanks so much for the status report. I was out all day Friday :-).
Appreciate all of your work on our behalf to get this resolved from your
side. Sounds like we shouldn't have any obstacles left to prevent meeting
their (NATO) deadline. Man, you Marines really know how to get the job
done :-). (we had a Marine IMA in our office for about 2 years...of all
the folks that have come and gone in 10 years, I miss him most for his
'force vs finesse' ways of making things happen! :-))

Mr Ferrante,
Thanks for your email containing the approval to release the videos created
with FAA radar data supplied by 84th RADES. Are there any implied
constraints in this approval? For example, are separate approvals needed
for the requests to release it to foreign government versus a general public
release? I ask for 3 reasons: 1) the current request is from the German
Air Force for use at an upcoming NATO Air Defense meeting, 2) the scenario
is also slated to be presented at another unclassified commercial forum
where foreign nationals may be present, and 3) we've had requests from other
non-government agencies (to include the commercial entity - AGI - whose
software we used to create the scenario) for general public release. If
possible, I'd like your approval for release to apply to each of these.
In the meantime, I'll send this up my chain to the Foreign Disclosure folks
so that the NATO meeting can include these videos. Hopefully, your release
memo (email) will suffice. But please let me know if there are caveats that
would prevent this release from applying to situations 2 and 3 above.
Thanks again for your help - your organization has been most helpful. I
apologize for the additional questions!
